1 BACKGROUND 배경 Guideline Complaints & Appeal Procedure 가이드 라인 불만 & 이의제기 절차 The SGS-HK-COC Program is the FSC-accredited programme of the SGS Group. SGS is an international company specialising in independent testing, inspection and certification. The SGS-HK-COC Program head office is based at SGS Hong Kong Ltd. Responsibility for maintaining and controlling the management system lies with this office. SGS-HK-COC 프로그램은 FSC 인정 자격을 획득한 SGS 그룹의 산림인증 서비스입니다. SGS 는 독립적인 테스팅, 검사 및 인증 서비스의 국제적인 기업입니다. IMPORTANT NOTES 중요 참고 사항 SGS can only become involved in dealing with complaints and appeals where they relate to the requirements of the SGS forest certification programme. 3 THE COMPLAINTS PROCEDURE 불만 처리 절차 Complaints against the performance of a certificate holder: 인증획득 기업의 성과에 대한 불만 사항 Step One: Step Two: The first objective is to have the cause of the complaint addressed as quickly as possible. For this reason it is best to address the complaint directly to the certificate holder. All operations which have been certified by SGS-HK-COC program are required to have their own complaints system, for addressing complaints raised by stakeholders. To assist in this process, complaints should be substantiated with objective evidence as far as possible and accurate descriptions of locations, dates and people involved 1 단계: 첫 번째의 목표는 불만 사항의 원인을 빨리 파악하는 것입니다. 이런 이유로, 가장 좋은 방법은 인증 기업에게 직접적으로 불만을 접수하는 것이 좋습니다. Submitting the Complaint to SGS: SGS 에 불만 사항 제출 : Step Three: A complaint must be submitted in writing, signed by the complainant and addressed to the relevant addressee. The note may be short and simple, but must include sufficient documented objective evidence to substantiate the complaint and identifying the basis for the complaint. Dissatisfaction without any justified reason or based on hearsay will not be considered as a complaint and should be rejected. 3 단계: 불만 사항은 작성자의 연락처 및 서명을 포함한 문서로 제출되어야 합니다. 기록은 짧고 간단할 수 있지만, 반드시 불만의 근거를 확인할 수 있는 객관적인 증거가 충분하게 포함되어야 합니다. 정당한 근거가 없거나 소문에 근거한 불만은 처리 대상으로 접수되지 않습니다. All operations which have been certified by SGS-HK-COC program are required to have their own complaints system, for addressing complaints raised by stakeholders.

4 Processing of the Complaint Step Four: Step Five: Step Six: The Local SGS Office / Program Manager / Assistant Program Manager will consider the complaint and decide if it is valid and whether it has been adequately addressed by the Certificate Holder. If the complaint is not considered valid, it will be referred back to the complainant explaining the reasons for the decision and requesting any additional information that may further support the validity of the complaint. The complainant is required to respond within 14 days with the required information. If the Local SGS Office / Program Manager / Assistant Program Manager considers that the complaint remains invalid, the complainant will be informed in writing. SGS will confirm receipt of the complaint (within 4 weeks) and provide information on the expected process for dealing with the complaint and where possible, a target date for resolution thereof. 5 단계: SGS 는 (4 주 이내) 불만 사항의 접수를 확인하고, 계획된 처리 가능일자를 가능한 포함해서 불만 처리에 대한 예상되는 절차에 대해 안내합니다. NOTE: It would be important to understand that whereas SGS will provide as much information as possible, some details relating to the outcome may be protected by the confidentiality clause in the SGS certification contracts. Where the complaint is accepted as valid a competent and impartial person(s) will be appointed to investigate the complaint or the Program Manager / Assistant Program Manager may decide to personally conduct the investigation. 6 단계: 불만 사항이 유효한 사항으로 접수되면, 해당 내용을 조사하기 위해 유능하고 공정한 사람이 선임되거나 프로그램 디렉터의 결정에 따라 직접 조사를 수행합니다. The complainant has an obligation to respond to correspondence and enquiries from SGS and failure to do so may lead to the complaint being closed 불만 제기자는 SGS 의 연락 및 요청에 대응할 의무가 있으면, 적절한 조치가 없을 때에는 불만 사항의 처리는 중단 될 수 있습니다. The objective is to resolve the complaint within 60 days of receiving same. 불만 사항은 접수 후 60 일 이내에 처리함을 목표로 하고 있습니다. Final Decision 최종결정 Step Seven: Step Eight: SGS will, subject to the rules of confidentially, inform the complainant about the results of its investigation and any appropriate actions planned or implemented. 7 단계: SGS 는 비밀 유지에 대한 규칙을 적용하여, 불만제기자 에게 조사의 결과 및 계획되거나 또는 실행된 조치들에 대해 안내합니다. Within 60 days of receiving the final information, the complainant must inform SGS if they remain dissatisfied with the decision by SGS. 8 단계: 불만 제기자는 SGS 의 결정에 만족스럽지 않다면, 최종 정보가 접수 된 후 60 일 이내에, 해당 사항을 SGS 에 알려야 합니다. If the complaint is not considered valid, it will be referred back to the complainant explaining the reasons for the decision and requesting any additional information that may further support the

5 Appeal 이의 제기 Step Nine: Step Ten: Step Eleven: Where the complainant is dissatisfied with decision by SGS, the complaint will be sent to the Appeal Committee for a final decision. 9 단계: 불만 제기자가 SGS 의 결정에 대해 만족스럽지 못한 경우, 불만 사항은 이의제기 위원회에 최종 결정을 위해 제출됩니다. 6 THE APPEALS PROCEDURE 이의제기 절차 What can be appealed? 이의제기를 요청할 수 있는 사항은? Adverse decisions by SGS that may be appealed include: SGS 에 의한 부정적인 결정에 대해 다음과 같은 사항을 요청할 수 있습니다.: refusal to accept an application; 신청 접수의 거절; refusal to proceed with an assessment; 심사 진행에 대한 거절; corrective action requests; 시정조치 요구 사항; changes in certification scope; 인증 범위의 변경; decisions to deny, suspend or withdraw certification; and 인증서의 효력정지 또는 회수, 거절에 대한 결정 및 any other action that impedes the attainment of certification. 인증서 획득을 지연시키는 어떠한 행동. General Notes 일반 참고 사항 Only a certificate holder can appeal against adverse certification decision. 인증을 획득한 기업만이 불리한 인증결정에 대해 이의제기를 할 수 있습니다. The appeal will be investigated and proposed actions specified in response to the appeal within 90 days of receiving same. 이의 제기 사항은 조사가 진행될 것이며, 접수된 지 90 일 이내에, 조치 사항을 포함하여 답변이 제공될 것 입니다 The appeal shall not suspend the validity of the decision which is being appealed, unless otherwise decided by the duly convened Appeals Panel. 제출된 이의 제기 사항은 적절히 소집된 심의 위원회의 결정 없이는 해당 결정의 유효성을 중단 할 수 없습니다. Processing of the Appeal by SGS Hong Kong SGS Hong Kong 에 의한 이의 사항의 처리 Step Two: Receipt of the appeal to Local SGS Office / Program Manager / Assistant Program Manager will be acknowledged within 10 days the appeal's recorded arrival. The acknowledgement shall include a copy of the appeals procedure. 2 단계: 지역 SGS 사무소 / 프로그램 매니저 / 보조 프로그램 매니저에 접수된 이의 사항은 접수일자로부터 10 일 이내에 관련사항의 접수를 인정합니다. 이의 접수의 인정은 이의제기 절차의 사본을 포함합니다. Step Three: Within 10 days of acknowledging receipt, the Local SGS Office / Program Manager / Assistant Program Manager shall decide on the validity of the appeal. If the issue cannot be considered an appeal as per definition, the Local SGS Office / Program Manager / Assistant Program Manager shall inform the appellant to agree on other means of solving the issue. If no agreement can be reached, the appeal will be rejected. If the appeal does not fully comply with the formal requirements, the appellant will be given 10 days to establish full compliance of the appeal with the formal requirements. 4 단계: 만약 이의 사항이 정식 요구 사항에 충분히 적합하지 않으면, 이의 제기자는 10 일 이내에 정식 절차에 부합하는 이의 사항을 준비 할 수 있는 기간이 제공됩니다. 8 The Appeals Committee 이의제기 위원회 Step Five: Step Six: Step Seven: Within 30 days of validating the appeal, the Local SGS Office / Program Manager / Assistant Program Manager will appoint an Appeals Committee. The Appeals Committee may seek the approval of the Program Manager / Assistant Program Manager for an extension of time which may be granted subject to a full explanation of the reasons for the extension of time being supplied to the appellant. 6 단계: 이의제기 위원회는 이의 사항이 접수 된 이후 90 일 이내에 관련 사항을 평가하고 판정 결과를 지역 SGS 사무소 / 프로그램 매니저 / 보조 프로그램 매니저에게 통보해야 합니다. 이의제기 위원회는 검토를 위해 추가적인 시간이 필요한 경우 관련 사항의 충분한 근거를 이의 제기자에게 제공해야 하며, 프로그램 매니저/보조 프로그램 매니저의 승인을 획득해야 합니다 The Local SGS Office / Program Manager / Assistant Program Manager shall inform the appellant of the decision of the Appeals Committee in writing, no later than 10 days after the date of the notification by the Appeals Committee.
