1 1 대한민국, 일본국 및 중화인민공화국 정부 간의 3국 협력 사무국 설립에 관한 협정 - 1 -

2 2 다) 는, 대한민국 정부, 일본국 정부 및 중화인민공화국 정부( 이하 함께 당사자 라 한 2010년 5월 30일 대한민국 주에서 개최된 3차 3국 정상회의 결정에 따라, 당사자 간 3 국 협력의 효율적 증진 및 관리를 위해 사무국을 설립하고, 기존의 대화 협력체를 강화하며, 를 희망하면서, 당사자 간 협력 관계를 더욱 증진시키는데 기여하기 다음과 같이 합의하였다 국 협력 사무국( 이하 사무국 이라 한다) 이 이에 설립된다. 2. 사무국은 대한민국( 이하 소재국 이라 한다) 에 위치한다. 2 사무국의 목적은 당사자 간 3 국 협의체의 운영 및 관리를 지원하고, 협력사업의 발굴과 이행을 촉진함으로써, 3국 간 협력 관계를 더욱 증진시키는데 기여하는 것이 다 사무국은 2에 언급된 목적을 달성하기 위하여 다음의 기능 및 활동을 수 - 2 -

3 국 협력 사무국( 이하 사무국 이라 한다) 이 이에 설립된다. 2. 사무국은 대한민국( 이하 소재국 이라 한다) 에 위치한다.

3 3 행한다. 가. 3 국 정상회의, 3 국 외교장관회의, 3 자 위원회 및 다른 장관급 회의, 그리고 3국 고위급회의와 같은 당사자 간 3 국 협의체(이하 협의체 라 한다) 의 운 영과 관리를 위하여 행정적, 기술적으로 지원, 그리고 필요한 경우 주요 협 의체에 사무국 대표를 참석하도록 치 나. 당사자 및 필요한 경우 그 밖의 국기구, 특히 다른 동아시아 협력체 와 연 락 및 정 다. 당사자 간 잠재적인 협력사업 발굴 및 확인 그리고 그 사업의 채택을 위 하여 관련 협의체에 대한 보고 라. 협력 사업 평가 및 보고서 작성, 필요 문서의 데이터베이스 구축 그리고 3 자위원회 또는 출 3국 외교장관회의의 승인을 위하여 연간 실적 보고서의 마. 3 국 협력 관련 중요 주에 대한 연구 수행, 사무국 홈페이지 관리 및 3국 협력에 대한 이해증진 2. 사무국은 3국 외교장관회의를 통하여 또는 3국 외교장관회의가 결정한 방식에 따라 당사자가 부여한 권한 범위 내에서 당사자의 감독하에 그 기능 및 활동을 수행한다. 4 사무국은 소재국 안에서 다음과 같은 법적 능력을 가진다. 가. 계약을 체결할 능력 나. 동산 및 부동산을 취득 및 처분할 능력 다. 소송을 기할 능력 5 1. 사무국은 다음 방식으로 지명 및 임명되거나 고용되는 한 명의 사무총장과 두 - 3 -

당사자 및 필요한 경우 그 밖의 국기구, 특히 다른 동아시아 협력체 와 연 락 및 정 다. 당사자 간 잠재적인 협력사업 발굴 및 확인 그리고 그 사업의 채택을 위 하여 관련 협의체에 대한 보고 라.

4 4 명의 사무차장 및 전문인력( 이하 함께 직원 이라 한다) 그리고 일반인력으로 구성된다. 가. 사무총장은 3 국 외교장관회의에서 대한민국, 일본국, 중화인민공화국 의 윤번으로하여 한 당사자가 지명하여 임명된다. 임기는 2년으로 한 다. 나. 당사자가 달리 합의하지 아니하는 한, 사무총장을 임명한 국가의 정부 외의 각 당사자는 각각 사무차장 1인을 지명하고 3국 외교장관회의에 서 이들을 사무차장으로 임명한다. 사무차장의 임기는 일반적으로 2년 으로 한다. 사무차장의 임명은 3국 외교장관회의의 승인을 얻어 추가 적으로 최장 2년의 범위 내에서 1 회 연장될 수 있다. 다. 사무총장은 당사자가 파견한 인력을 전문인력으로 임명한다. 라. 사무총장은 사무국 기능 및 활동 수행에 필요한 일반인력을 고용할 수 있다. 2. 사무국에 사무총장 및 사무차장으로 구성된 협의이사회를 둔다. 협의이사회 는 심의를 위해 출된 사안에 대하여 협의하고 총의로 결정한다. 32 항에 따라 중요 사안에 관하여 당사자와 협의한다. 협의이사회는 3. 3 국 외교장관회의의 승인을 받아, 사무총장은 다양한 분야에서의 3국 협력 촉 진을 목적으로 사무국의 기능 및 활동을 효율적으로 수행하도록 내부 부서를 설 치할 수 있다. 6 사무총장은 사무국을 대표하며 사무국이 수행하는 기능 및 활동에 대하여 책임 을 진다. 또한, 사무총장은 특히 다음과 같은 사무국의 행정에 책임을 진다. 가. 사무국의 연간 예산뿐만 아니라 사무국의 기능 및 활동에 대한 연례 보 고서와 필요한 경우 임시보고서를 준비하고, 3국 고위급회의의 승인을 받아 이를 3국 외교장관회의에 승인을 위하여 출 나. 3국 외교장관회의의 승인을 받아, 사무국 내부 규칙 및 규정을 정 또는 개 정 - 4 -

사무차장은 사무총장의 기능 및 활동 수행을 보한다. 이와 관련하여, 사 무차장은 특히 다음의 임무를 수행한다. 가. 3국 협력의 향후 점진적 발전 방향에 관하여 사무총장에게 언 나. 사무총장이 부여한 권한에 따라 회의, 행사 그리고 그 밖의 경우에 사무국 을 대표 다.

6 사무국 및 직원은 소재국 안에서 10 및 11의 규정에 따라 사무국 의 목적 달성과 그 기능 및 활동 수행에 적절한 특권과 면를 누린다. 2. 소재국 정부 이외의 당사자는 각자의 국가 안에서 자국 법령이 허용하는 한도 까지 사무국의 적절한 운영에 필요하다고 간주되는 편의를 부여할 수 있다. 3. 민사 또는 행정절차에 관한 소재국의 관할권으로부터의 특권과 면는 계약 과 관련하여, 또는 사무국 및 직원이 이용하거나 소유하는 차량, 선박 또는 항공기에 의한 사고로 발생한 손해배상액으로서 보험으로 처리되지 않는 손해배상액에 대 한 민사 소송에 대하여는 부여되지 아니한다. 4. 사무국은 이 협정에 따라 부여되는 특권과 면 및 편의와 관련된 어떠한 남용의 발생을 방지하기 위하여 소재국의 관할 당국과 항상 협력한다. 5. 소재국 정부가 이 협정에 따라 부여되는 특권 또는 면의 남용이 발생하였 다고 판단하는 경우, 그러한 남용이 발생하였는지를 결정하고, 발생한 경우 그러한 남용의 재발방지를 보장하기 위하여 소재국 정부는 사무국과 협의한다 사무국, 그 재산 및 자산은 사무국이 명시적으로 면를 포기한 경우를 외하고 법적 절차로부터 면된다. 민사 또는 행정 절차에 관한 관할권으로부터의 어떠한 면의 포기도 판결 집행에 대한 면의 포기를 의미하지 않으며, 판결 집 행을 위해서는 별도의 면 포기가 필요하다. 앞 문장에도 불구하고, 사무국이 법 적 절차를 개시하는 경우에는 해당 법적 절차뿐만 아니라 그에 따른 판결 집행에 대한 면도 포기한 것으로 추정된다. 2. 사무국의 공관은 불가침이다. 사무국의 문서, 일반적으로 사무국에 속하는 - 6 -

사무국은 이 협정에 따라 부여되는 특권과 면 및 편의와 관련된 어떠한 남용의 발생을 방지하기 위하여 소재국의 관할 당국과 항상 협력한다. 5.

7 7 모든 공식 문서 및 서류는 불가침이다. 3. 사무국은 공적 통신과 관련하여 소재국 정부가 소재국 안의 외교사절 또는 모든 국기구에 부여하는 대우보다 불리하지 아니한 대우를 누린다. 사무국은 외 교신서사 및 외교행낭과 동일한 특권과 면를 가지는 신서사 또는 봉인된 행낭에 의하여 서신 및 그 밖의 공적 통신을 발송하고 접수할 권리를 가진다. 하고, 4. 사무국은 어떠한 종류의 재정적 통, 규 또는 지불유예의 약을 받지 아니 가. 자금 또는 모든 종류의 통화를 보유할 수 있고, 모든 통화의 계좌를 운용할 수 있으며 나. 자금과 통화를 자유로이 소재국으로, 소재국으로부터, 또는 소재국 안에 서 송금할 수 있으며, 보유 통화를 다른 통화로 태환할 수 있다. 5. 이 4 항에 언급된 권리를 행사할 때, 사무국은 소재국의 국내법을 준수하고, 소재국 정부가 기한 의견은 사무국의 이익을 손상하지 않고 실행될 수 있는 것으로 여겨지는 한 적절히 존중된다. 6. 사무국과 그 재산 및 자산은, 가. 사실상 공공요금에 불과한 경우를 외하고 모든 직접세로부터 면된 다. 나. 사무국이 공적 사용을 위하여 수입 또는 수출한 물품과 관련하여 관세 및 수출입 상의 금지와 한으로부터 면된다. 그러나 그 면세된 수입 물 품은 소재국 정부가 정한 건에 따른 경우를 외하고는 소재국 안에 서 판매되지 않는 것으로 양해한다. 다. 그 출판물과 관련하여 관세 및 수출입상의 금지와 한으로부터 면된 다. 7. 사무국은 원칙적으로 물품세와 동산과 부동산의 판매가격의 일부를 구성하는 세에 대하여 면를 요청하지 아니할 것이나, 그럼에도 불구하고 공적 사용을 목적으 로 그러한 세가 부과된 중요재산을 구매하는 경우, 소재국 정부는 가능하다면 언 - 7 -

이 4 항에 언급된 권리를 행사할 때, 사무국은 소재국의 국내법을 준수하고, 소재국 정부가 기한 의견은 사무국의 이익을 손상하지 않고 실행될 수 있는 것으로 여겨지는 한 적절히 존중된다. 6. 사무국과 그 재산 및 자산은, 가. 사실상 공공요금에 불과한 경우를 외하고 모든 직접세로부터 면된 다. 나.

8 8 든지 세액의 감면 또는 환급을 위한 적절한 행정적 치를 할 수 있다 직원은, 가. 사무국이 지급하는 보수 및 수당에 대한 세로부터 면된다. 나. 소재국에 거주하는 배우자 및 부양가족과 더불어 출입국 한, 외국인 등록 및 국민적 역무상 의무에서 면된다. 다. 사무국에 최초로 부임할 때 본인과 배우자 및 부양가족의 사용을 위한 가구 및 가정용품을 면세로 수입할 권리를 가진다. 라. 외환 편의와 관련하여 소재국에 위치한 다른 국기구 소속의 동등한 지위의 직원에 부여되는 대우보다 불리하지 아니한 대우를 부여받는 다. 2. 소재국 정부는 소재국 국민 또는 영주권자에게는 이 에 언급된 특권과 면 를 부여할 의무를 지지 아니한다. 3. 특권과 면는 사무국의 이익을 위하여 부여되며, 직원의 개인적 이익을 위하 여 부여되지 아니한다. 사무총장은 면가 정의의 실현을 저해하거나 사무국의 이익 을 침해함이 없이 포기될 수 있다고 판단하는 경우, 사무차장과의 협의를 통해 이 협 정에 따라 직원들에게 부여된 면를 포기할 권리와 의무를 가진다. 사무총장과 사무 차장에게 부여된 면는 필요한 경우 3 국 외교장관회의에서 포기될 수 있다. 12 사무국의 실무언어는 영어로 한다

소재국 정부는 소재국 국민 또는 영주권자에게는 이 에 언급된 특권과 면 를 부여할 의무를 지지 아니한다. 3. 특권과 면는 사무국의 이익을 위하여 부여되며, 직원의 개인적 이익을 위하 여 부여되지 아니한다.

9 9 총장은 사무국의 재정 사안은 매년 감사를 받으며 3 국 외교장관회의에 보고된다. 사무 3 국 외교장관회의의 승인을 받아 감사 절차를 수립한다. 14 어떠한 당사자도 이 협정의 개정을 안할 수 있다. 합의에 의하여 개정될 수 있다. 이 협정은 당사자의 서면 15 각 당사자는 그 밖의 모든 당사자에게 이 협정의 발효에 필요한 자국의 내부 절차가 완료되었음을 외교 경로를 통하여 서면 통보한다. 이 협정은 마지막 통보 가 이루어진 날에 발효한다. 이상의 증거로, 아래 서명자는 그들 각자의 정부로부터 정당하게 권한을 위임받 아 이 협정에 서명하였다. 이 협정은 2010년 12월 16일 서울에서 영어로 3 부 작성되었다. 대한민국 정부를 대표하여 일본국 정부를 대표하여 - 9 -

이 협정은 당사자의 서면 15 각 당사자는 그 밖의 모든 당사자에게 이 협정의 발효에 필요한 자국의 내부 절차가 완료되었음을 외교 경로를 통하여 서면 통보한다.

11 11 AGREEMENT ON THE ESTABLISHMENT OF THE TRILATERAL COOPERATION SECRETARIAT AMONG THE GOVERNMENTS OF THE REPUBLIC OF KOREA, JAPAN AND THE PEOPLE S REPUBLIC OF CHINA

12 12 The Government of the Republic of Korea, Japan and the People's Republic of China (hereinafter jointly referred to as the "Parties"), Desiring to establish a secretariat for the efficient promotion and management of trilateral cooperation among the Parties and to enhance existing dialogue mechanisms and contribute to the further promotion of their cooperative relations as decided at the Third Trilateral Summit held on May 30, 2010, in Jeju island, the Republic of Korea, Have agreed as follows: Article 1 1. The Trilateral Cooperation Secretariat (hereinafter referred to as the "Secretariat") is hereby established. 2. The Secretariat shall be located in the Republic of Korea (hereinafter referred to as the "host country"). Article 2 The objective of the Secretariat is to contribute to the further promotion of cooperative relations among the three countries by providing support for the operation and management of the trilateral consultative mechanisms among the Parties and by facilitating the exploration and implementation of cooperative projects. Article 3 1. In order to achieve the objective referred to in Article 2, the Secretariat shall carry out the following functions and activities: (a) provide administrative and technical support for the operation and management

the Third Trilateral Summit held on May 30, 2010, in Jeju island, the Republic of Korea, Have agreed as follows: Article 1 1.

13 13 of such trilateral consultative mechanisms among the Parties (hereinafter referred to as the "consultative mechanisms") as the Trilateral Summit Meeting, the Trilateral Foreign Ministers' Meeting, the Three-Party Committee and other ministerial meetings, and the Trilateral Senior Foreign Affairs Officials Consultation and send, if necessary, its representatives to attend major consultative mechanisms; (b) communicate and coordinate with the Parties, and if necessary, with other international organizations, particularly with other East Asian cooperation mechanisms; (c) explore and identify potential cooperative projects among the Parties, and report those projects to the relevant consultative mechanisms for adoption; (d) evaluate the cooperative projects and draft reports on them, compile necessary documents into database, and submit annual progress reports to the Three-Party Committee or the Trilateral Foreign Ministers' Meeting for approval; and (e) conduct research on important issues related to the trilateral cooperation, manage the Secretariat s website, and promote understanding of the trilateral cooperation. 2. The Secretariat shall carry out its functions and activities within its mandate authorized by and under the supervision of the Parties through the Trilateral Foreign Ministers' Meeting or in a manner decided by the Trilateral Foreign Ministers Meeting. Article 4 In the host country, the Secretariat shall have the legal capacity: (a) to contract; (b) to acquire and dispose of movable and immovable property; and (c) to institute legal proceedings

mechanisms; (b) communicate and coordinate with the Parties, and if necessary, with other international organizations, particularly with other East Asian cooperation mechanisms; (c) explore and

14 14 Article 5 1. The Secretariat shall be comprised of a Secretary-General, two Deputy Secretary-Generals and Professional Staffs (hereinafter jointly referred to as the "officials") and General Services Staffs to be nominated and appointed, or employed, in the following ways: (a) The Secretary-General shall be appointed at the Trilateral Foreign Ministers Meeting upon nomination of a Party on a rotational basis in the order of the Republic of Korea, Japan and the People s Republic of China. The tenure of office shall be two years. (b) Unless otherwise agreed by the Parties, each Party other than the Government of the country of the Secretary-General shall nominate a Deputy Secretary-General respectively who shall be appointed at the Trilateral Foreign Ministers Meeting. The tenure of office shall, in general, be two years. The appointment of the Deputy Secretary-General may be renewed once for an additional period of up to two years with the approval of the Trilateral Foreign Ministers Meeting. (c) The Secretary-General shall appoint the personnel seconded by the Parties as the Professional Staff. (d) The Secretary-General may employ the General Services Staff as needed to carry out the functions and activities of the Secretariat. 2. The Secretariat shall have the Consultative Board comprised of the Secretary-General and the Deputy Secretary-Generals. The Consultative Board shall consult and make decisions by consensus on matters submitted for its consideration. The Consultative Board shall consult with the Parties on matters of importance in accordance with paragraph 2 of Article Subject to the approval of the Trilateral Foreign Ministers Meeting, the Secretary-General may establish the departments of the Secretariat to efficiently carry out the functions and activities of the Secretariat with a view to facilitating trilateral cooperation in various areas

nominated and appointed, or employed, in the following ways: (a) The Secretary-General shall be appointed at the Trilateral Foreign Ministers Meeting upon nomination of a Party on a rotational basis

15 15 Article 6 The Secretary-General shall represent the Secretariat and be responsible for the functions and activities carried out by the Secretariat. The Secretary-General shall also be responsible for the administration of the Secretariat, in particular as follows: (a) prepare annual and, where necessary, ad-hoc reports on the functions and activities of the Secretariat, as well as an annual budget of the Secretariat, and submit them, with the approval of the Trilateral Senior Foreign Affairs Officials Consultation, to the Trilateral Foreign Ministers' Meeting for approval; (b) establish and amend internal rules and regulations of the Secretariat subject to the approval of the Trilateral Foreign Ministers' Meeting; (c) establish the basic terms and conditions of the officials secondment, including their salary matters, subject to the approval of the Trilateral Foreign Ministers Meeting, and suggest the termination of the appointment of the Professional Staffs to the Party which seconds them after the consultation with the Deputy Secretary-Generals; (d) establish General Services Staff positions, and terms and conditions of employment, including salaries, subject to the approval of the Trilateral Foreign Ministers' Meeting, and employ qualified personnel for the General Services Staff positions and dismiss the General Services Staff, as necessary, in accordance with the rules and regulations referred to in sub-paragraph (b) of this Article; and (e) enter into contracts required for the operation of the Secretariat. Article 7 1. The Deputy Secretary-General shall assist the Secretary-General in carrying out his/her functions and activities. In this connection, the Deputy Secretary General shall

16 16 conduct, in particular, the following duties: (a) provide advice to the Secretary-General on the future direction of the progressive development of trilateral cooperation; (b) represent the Secretariat at conferences, ceremonies, and other occasions as authorized by the Secretary-General; (c) provide support for research activities of the Secretariat; and (d) perform other functions and activities that may be mandated by the Secretary-General. 2. The Deputy Secretary-General shall act for the Secretary-General in case of his/her absence or inability to perform his/her duties in accordance with the rules and regulations referred to in sub-paragraph (b) of Article 6. Article 8 1. The Government of the host country shall be responsible for providing and arranging the premise for the operation of the Secretariat. 2. The operational costs of the Secretariat shall be met from equal contributions of the Parties to be made subject to their respective national laws and regulations. Article 9 1. In the host country, the Secretariat and the officials shall enjoy privileges and immunities in accordance with the provisions of Articles 10 and 11, as appropriate for the achievement of the Secretariat's objective and the carrying out of its functions and activities. 2. The Parties other than the Government of the host country may grant, in their respective countries and to the extent permitted by their respective national laws and

activities that may be mandated by the Secretary-General. 2.

17 17 regulations, such facilities as may be deemed necessary for the proper operation of the Secretariat. 3. The privileges and immunities from jurisdiction of the host country in respect of civil or administrative proceedings shall not be granted in relation to a contract, or a civil action for damages arising from an accident caused by a motor vehicle, vessel or aircraft, used or owned by the Secretariat and the officials where those damages are not recoverable from insurance. 4. The Secretariat shall cooperate at all times with the appropriate authorities of the host country to prevent the occurrence of any abuse in connection with the privileges, immunities and facilities granted under this Agreement. 5. If the Government of the host country considers that there has been an abuse of a privilege or immunity granted under this Agreement, consultations shall be held between the Government of the host country and the Secretariat to determine whether any such abuse has occurred and, if so, to ensure that no repetition of such abuse occurs. Article The Secretariat, its property and assets shall enjoy immunity from legal process except where it has expressly waived its immunity. Any waiver of immunity from jurisdiction in respect to civil or administrative proceedings shall not be held to imply waiver of immunity in respect to the execution of the judgment, for which a separate waiver shall be necessary. Notwithstanding the preceding sentence, in case the Secretariat initiates a legal process, waiver of immunities in respect not only of that legal process but also of the execution of a judgment thereof is presumed. 2. The premises of the Secretariat shall be inviolable. The archives of the Secretariat and, in general, all official papers and documents belonging to the Secretariat shall be

The Secretariat shall enjoy for its official communications, treatment not less favorable than that accorded by the Government of the host country to foreign diplomatic missions or any international organizations in the host country. The Secretariat shall have the right to dispatch and receive correspondence and other official communications by courier or in sealed bags, which shall have the same privileges and immunities as diplomatic couriers and diplomatic bags. 4. Without being restricted by financial controls, regulations or moratoria of any kind, the Secretariat may: (a) hold funds or currency of any kind and operate accounts in any currency; and (b) freely transfer its funds or currency to and from the host country or within the host country and convert any currency held by it into any other currency. 5. In exercising the rights referred to in paragraph 4 of this Article, the Secretariat shall comply with the national laws of the host country, and shall pay due regard to any representation by the Government of the host country in so far as it is considered that effect can be given to such representation without detriment to the interests of the Secretariat. 6. The Secretariat, its property and assets shall be: (a) exempt from all direct taxes except those which are, in fact, no more than charges for public utility services; (b) exempt from customs duties and from prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Secretariat for its official use. It shall be understood, however, that articles imported under such exemption shall not be sold in the host country except under conditions determined by the Government of the host country; and (c) exempt from customs duties and prohibitions and restrictions on imports and exports in respect of its publications

While the Secretariat will not, as a general rule, claim exemption from excise duties and from taxes on the sale of movable and immovable property which form the part of the price to be paid, nevertheless, when the Secretariat is making important purchases for official use of property on which such duties and taxes have been charged, the Government of the host country may, whenever possible, make proper administrative arrangements for the remission or return of the amount of duty or tax. Article The officials shall: (a) be exempt from taxation on the salaries and emoluments paid to them by the Secretariat; (b) be immune, together with their spouses and relatives dependent on them living in the host country, from immigration restrictions, alien registration and national service obligations; (c) have the right to import free of duty furniture and household goods for their personal use or for use by their spouses and relatives dependent on them at the time of their initial posting at the Secretariat; and (d) be accorded, in respect of exchange facilities, treatment not less favorable than that accorded to officials of comparable rank of any other international organizations posted in the host country. 2. The Government of the host country shall not be obliged to grant the privileges and immunities referred to in this Article to the officials who are nationals or permanent residents of the host country. 3. Privileges and immunities are granted to the officials in the interests of the Secretariat only, and not for their personal benefit. The Secretary-General has the right and duty to waive the immunity granted to the officials under this Agreement through consultation with the Deputy Secretary-Generals in any case where the

possible, make proper administrative arrangements for the remission or return of the amount of duty or tax. Article 11 1.

20 20 Secretary-General considers that the immunity would impede realization of justice and can be waived without prejudice to the interests of the Secretariat. The immunity granted to the Secretary-General and Deputy Secretary-Generals may be waived, as and when necessary, at the Trilateral Foreign Ministers' Meeting. Article 12 The working language of the Secretariat shall be English. Article 13 The financial affairs of the Secretariat shall be audited annually and shall be reported to the Trilateral Foreign Ministers Meeting. The Secretary-General shall establish the auditing procedures subject to the approval of the Trilateral Foreign Ministers Meeting. Article 14 Any Party may propose amendments to this Agreement. This Agreement may be amended by written agreement of the Parties. Article 15 Each Party shall notify all other Parties in writing through diplomatic channels that their respective internal procedures necessary for the entry into force of this Agreement have been completed. This Agreement shall enter into force on the date when the last notification thereof is issued

Article 12 The working language of the Secretariat shall be English.
