Deaths in Official Custody In Hong Kong, whenever there is any death of prisoner including suicide in prison, a case will be reported to the Police. The police will investigate the case and if there is no crime element involved, the police will assist the Coroner for holding a death inquest. The death inquest must be held for every prisoner died in custody in accordance with the Laws of Hong Kong, Chapter 504, Section 15 of the Coroners Ordinance on: Deaths in Official Custody, which reads as follows: (1) Where a person dies whilst in official custody, a coroner shall as soon as practicable hold an inquest into the death. (2) A coroner shall hold an inquest under this section with a jury selected in accordance with section 23. At the death inquest, the coroner will look into the cause of death of the deceased prisoner (e.g. death by hanging or death by illness etc.) and not to decide on the question of civil liability. Civil claims and liabilities (i.e. compensation arising from staff negligence) should be heard by way of civil proceedings. In short, if the family members Monthly Correctional Review * 148
consider that the death of the prisoner who committed suicide is the result of the staff negligence, he/she may seek civil proceedings in court for compensation. It is up to the court to decide whether compensation is necessary. As far as I know, this kind of compensation arising from prisoner's suicide is very rare in Hong Kong.
