7 Greetings everyone! We welcome all of you to Korea. You will now be working in various industrial sectors in Korea for the next three years. We will make our utmost efforts to protect your rights and ensure that you are treated fairly in accordance with related laws. Please read through the information given in this booklet as the booklet is designed to provide you with guidelines on your stay and employment in Korea. We look forward to your active cooperation. 11 Guide to Employment in Korea for Foreign Workers Foreign workers employed by companies in Korea under the EPS enjoy legal employment status (sojourn status: E-9) and are thus protected just as Koreans are under the Labor Standards Act and other labor laws. Foreign workers are required to join the Industrial Accident Compensation Insurance, National Health Insurance, and National Pension, and are eligible to receive benefits from such systems. It is illegal for employers to discriminate against foreign workers by, for example, violating employment contracts or dismissing them without justifiable cause. At the same time, foreign workers must abide by all Korean laws related to their employment and actions and will face punishment for any violation of the law. Foreign workers may work in Korea for up to three years. At the expiry of their sojourn period, they must leave Korea. Foreign workers may not be accompanied by any members of their family while they are employed in Korea.

13 Guide to Employment in Korea for Foreign Workers A foreign worker must go to a designated employment training institute upon his/her entry into Korea and complete an employment training course for foreign workers. The training institutes for foreign workers who applied for manufacturing job are : the Human Resources Development Service of Korea(for ethnic Korean foreign workers), the Korea International Labor Foundation(for workers from Vietnam, Mongolia, Thailand and China), and the Korea Federation of Small and Medium Business(for workers from Sri Lanka, the Philippines, Indonesia, Uzbekistan, Pakistan, Cambodia, Nepal, Bangladesh, Myanmar, Kyrgyzstan and Timor Leste) (Manufacturing) Employment training will last 20 hours or more (between 2 nights-3 days and 3 nights-4 days) and cover the understanding of Korea, related laws and basic knowledge essential to their employment. A foreign worker is required to undergo a medical checkup during the employment training period.

15 Guide to Employment in Korea for Foreign Workers A foreign worker must join the Casualty Insurance and the Return Cost Insurance within 15 days and 80 days, respectively, from the effective date of the employment contract. (Workers are, in theory, supposed to sign the insurance agreement during the employment training period) - Casualty Insurance : Insurance against death or disability of a foreign worker other than occupational accidents (a foreign worker is required to sign this insurance agreement during the employment training period). - Return Cost Insurance : This insurance is designed to build up savings to cover going-home expenses (air fare) of foreign workers. The insurance premium will be deposited automatically to the insurance company from his/her bank account within 80days after entry. The bank account will be opened during the employment training in Korea. A foreign worker placed at a workplace is required to apply for and receive an foreigner registration at an immigration office or a branch office with jurisdiction for the region in which he/she resides within 90 days from entry into Korea. A foreign worker must work at the workplace, where he/she has concluded an employment contract with before entering Korea and must not leave the workplace to work at a different workplace without justifiable reason.

17 Guide to Employment in Korea for Foreign Workers Changing workplace is allowed only through the district Job Center of the MOL in exceptional cases where the current employment relations cannot be continued due to such reasons as follows:

19 Guide to Employment in Korea for Foreign Workers leaves his/her workplace without permission from the employer; fails to find a job within two months from the time the application for a workplace change(job application) is filed and thus, has not been able to receive a permit for a workplace change; or finds a job him/herself or through friends, co-workers and private job placement agencies, instead of through Job Center. In principle, changing workplace shall be restricted to a total of three times. But in the event the three changes were made due to grounds solely accountable to the employer, an additional change may be allowed. Renewal of labor contract and extension of sojourn period A foreign worker shall renew his/her labor contract with the employer every year during the period of employment. When he/she has renewed the labor contract, he/she must obtain a permit to extend the sojourn period from the Immigration Office with jurisdiction over the workplace. Employment period limited to three years, accompanying family members not allowed, and timely departure required The period of employment in Korea for a foreign worker is limited to a maximum of three years. After the lapse of three years, he/she must leave Korea. A foreign worker may not be accompanied by his/her family during the employment period.

21 Guide to Employment in Korea for Foreign Workers Foreign workers who voluntarily leave Korea upon expiration of the three-year work permit will be allowed to reenter the country under the EPS six months after their departure date. However, a worker whose employer made request to the Ministry of Labor to employ the worker again before he/she leaves for his/her home country can return to Korea only one month after leaving the country. E-8 visa holders (i.e., foreign workers who entered Korea under the Industrial Trainee System and whose visa status will be changed to E-9 with the implementation the EPS) from countries that have signed a MOU with Korea are treated the same as those entering Korea under the EPS. Departure Guarantee Insurance (purchased by employers) - When a foreign worker, who has continuously worked for one year or more at a workplace with five or more full-time employees, moves to another workplace or leaves Korea and applies for insurance benefits to the HRD-Korea or Samsung Fire & Marine Insurance the insurer will directly send the insurance benefits to the worker's account. Return Cost Insurance (purchased by foreign workers) - When a foreign worker is planning to leave Korea (excluding a temporary departure) he/she shall submit a "Departure Schedule Notification Form" to an Job Center and file claim

23 Guide to Employment in Korea for Foreign Workers with the HRD-Korea or Samsung Fire & Marine Insurance for benefits. The insurer will then send the insurance benefits to the worker's account. Casualty Insurance (purchased by foreign workers) - When a foreign worker suffers from death or permanent impairment other than an occupational accident and file claim with the HRD-Korea or Samsung Fire & Marine Insurance for benefits, the insurer will investigate the accident report and send the insurance benefits to the worker's account. Guarantee Insurance (purchased by employers) - In the event an employer of a workplace, with less than 300 full-time workers or a workplace not covered by the Wage Claim Guarantee Act, delays payment of wages, the worker may file claim with the HRD-Korea or Seoul Guarantee Insurance for benefits. The insurer will then examine the case to determine whether payment of wages has been actually delayed and if so, send the insurance benefits to the worker's account.

In the event a foreign worker has committed an act that he/she is not allowed to in accordance with the rules that govern his/her status of sojourn or in case a foreign worker remains in Korea after the period of lawful stay is over, [Article 23, Article 25] f. In the event a foreign worker has left his/her designated workplace without permission or has not obtained a permit to change workplace or add workplace ; or [Article 18, Article 21] g. In the event a foreign worker has not applied for and received an foreigner registration within a certain number of days as required by law, [Article 31] h. In the event a foreign worker has not made a notification of moving-in when changing the area of residence, [Article 36] i. In the event a foreign worker has not duly reported a change in any matters related to the foreigner registration, [Article 35] j. In the event a foreign worker knowingly makes false entries in various application forms or reports, [Article 100]

29 Guide to Employment in Korea for Foreign Workers Standard working hours are 40(44)hours a week (eight hours a day). Upon agreement between a foreign worker and the employer, extended working hours are allowed. Wages are to be paid to the workers account or in cash at least once a month on the day stated on the labor contract. Foreign workers are entitled to receive additional wages for extended working hours, working at nights (22:00-06:00) or on holidays (except workplaces with less than 5 workers) Foreign workers who have worked at a workplace for over one (1) year are eligible to receive severance pay. (except workplaces with less than 5 workers)

31 Guide to Employment in Korea for Foreign Workers Foreign workers are eligible to receive at the least the minimum wage stipulated by law. A foreign worker who suffers an occupational accident or disease is eligible to receive medical care benefits, wage replacement benefits, disability benefits, survivors benefits. In the event a foreign worker who is out of work, due to such causes as the employer's bankruptcy, has not received wages and severance pay, the worker is eligible to receive wages for the last three months worked, severance pay for the last three years of employment, and unemployment benefits for the past three months from the Korean government.

33 Guide to Employment in Korea for Foreign Workers In the event a foreign worker has not received wages or severance pay on time; has been assaulted by an employer or supervisor; or has been forced to work overtime, at nights or on holidays, In the event the workplace safety and health standards are not met at a workplace, As regards matters related to change of workplaces or job placement; grievance counseling on any other difficulties foreign workers confront,

35 Guide to Employment in Korea for Foreign Workers In the event counseling or guidance in the native languages of the foreign worker is needed ; or counseling for civil appeals or guide to a counseling agency is needed and other events, Receiving reports or petitions on delayed payment of wages (Civil Affairs Division) Asking the employer to appear at the office (Labor Inspector) Fact-finding (Labor Inspector) Ordering the employer to pay overdue wages if the fact-finding shows that the employer has delayed payment of wages without justifiable cause (Labor Inspector) Subjecting the employer to related laws in the event he/she still does not pay overdue wages (Prosecutor)

37 Guide to Employment in Korea for Foreign Workers In the event counseling on matters related to sojourn such as issuance of foreigner registration certificate, extension of the sojourn period, or permission for a workplace change is needed; or In the event a foreign worker has been treated unfairly or is feared to be the target of unfair treatment in entering or leaving Korea or while staying in Korea, In case a foreign worker needs to apply for industrial accident compensation or medical care because of an industrial accident (work-related disease, injury, or death), In the event a foreign worker falls victim to a crime or has been treated unfairly in his/her period of employment,
