John: Seemingly he was the one arrested for sheep stealing and transported to Australia, hence not found on the 1851 census of England and Wales. Convicted at the Derby Quarter Sessions 1 July 1845 and sentenced to 10 years for sheep stealing.. On the Convict Indent he was listed as aged 31, 5ft 9.25 inches tall, protestant, able to read and write, married. Additional information states that he had a fresh complexion, brown hair, and hazel eyes. Derby Mercury 9 July 1845 TRAIL OF PRISONERS On the Petit Jury being sworn, the learned Chairman handed to the foreman a letter alluded to in his charge to the Grand Jury, intimating that three letters, all of siomilar character, had been received by the baliff, who had very properly given them up to the Court The first prisoner placed at the bar was John Eaton, aged 31, who pleaded Guilty to having on the 3rd of June, at the parish of Repton, feloniously stolen four ewe sheep, the property of William Dawson. Several highly respectable witnesses gave the prisoner an excellent character, and Mr Boden, on the part of the prosecutor, recommend him to mercy.. To be transported for 10 years. John was given a conditional pardon in 1851 and promptly does a bunk never to be heard of again. The VDL Comptroller of Convicts has an ad in the Tassie papers in 1856 asking the public to inform him of the whereabouts of about fifty pardoned convicts including John Eaton. He could of course have changed his name and nicked across to Victoria which a lot did so there is really no hope of finding him.
