39 노일석 미국의 약복용으로 인한 사망과 보험 389 양대로 복용하였는지는 문제가 안 될 것이다. 그러나 알코올 이나 약 이 존재하 였다는 것만으로 면책을 인정하는 약관의 효력은 인정하기 곤란할 것이다. 약복 용이 정신장애를 가져오지는 않았으나 약복용으로 바로 사망하면 면책약관이 적 용된다 할 것이다. 라 우리나라 금융감독원의 질병ㆍ상해보험표준약관 제5조(보험금을 지급하지 않는 사유) 제1항 제1호는 피보험자가 고의로 자신을 해친 경우(다만, 피보험자가 심신상실 등으로 자유로운 의사결정을 을 할 수 없는 상태에서 자신을 패진 경 우에는 보험금을 지급함) 를 보험자의 면책사유로 들고 있으나, 알코올 중독, 습관성 약품 또는 환각제의 복용 및 사용 으로 인한 상해를 면책사유로 들고 있지는 않고 다만 각 회사의 보험약관에서 그것을 정하고 있을 뿐이다. 그러나 단순히 습관성 약품 또는 환각제의 복용 및 사용 으로 인한 상해를 면책사유로 하는 경우에는 (1) 습관성 약품 또는 환각제와 같은 불법적인 약의 사용만을 면책으로 하고 있으므로 적법한 약의 과다복용이나 오용의 문제는 다 루지 않고 있고, (2) 그러한 약의 사용으로 인한 이라고만 규정하고 있으므로, 미국의 약복용 면책약관에서 제기되는 여러 문제를 해결하고 있지 못하며 특히 무엇이 약의 사용으로 인한 상해인지라는 것을 결정하여야 되므로 원래의 문제 로 회기하는 문제점이 있다 할 것이다.
