4 조 약 2009년 11월 17일 제49회 국무회의 심의를 거쳐 2009년 11월 23일 서울에서 유명환 외교 통상부장관과 Helen Clark 국제연합개발계획 총재 간에 서명된 후, 발효를 위해 필요한 국내절 차가 완료되었음을 상호 통보한 날인 2010년 1월 1일에 발효된 범세계적 개발협력을 위한 국제 연합개발계획 서울 정책센터의 설립에 관한 대한민국 정부와 국제연합개발계획 간의 협정 을 이에 공포합니다. 대 통 령 국 무 총 리 국 무 위 원 외교통상부 장 관 이 명 박 정 운 찬 유 명 환 조약 제1986호 범세계적 개발협력을 위한 국제연합개발계획 서울 정책센터의 설립에 관한 대한민국 정부와 국제연합개발계획 간의 협정 (국문번역문) 대한민국 정부(이하 정부 라 한다)와 국제연합개발계획(이하 UNDP 라 한다)은 (이하 함께 당 사자 라 한다), UNDP는 1965년 11월 22일의 총회 결의 2029에 의하여 설립된 국제연합 보조기관이며, 당사자가 정부에 대한 UNDP 원조에 관한 협정(이하 SBAA 라 한다)을 1978년 12월 14일 체결 하였고 이 협정은 그 조항에 따라 정부의 UNDP에 대한 통보로써 2010년 1월 1일 종료되었으며, 정부의 UNDP와의 협력이 2006년 4월 25일 당사자 간에 서명된 기본협력협정의 체결과 정부의 재정 지원으로 2010년부터 개시되는 국제연합새천년개발목표(MDG) 주제별 신탁기금의 설립과 함 께 발전해오고 있으며, UNDP는 대한민국에 범세계적 개발 협력에 관한 정책센터(이하 정책센터 라 한다)를 설치하는데 관심이 있고, 정부는 그러한 센터를 대한민국에 설치하는 것에 합의했으며 나아가 정책센터가 기능 을 수행하는데 필요한 모든 특권 면제 및 편의를 UNDP에 부여하는 것에 합의하는 점에 비추어, 당사자는 이에 따라 다음과 같이 합의한다. 제1조 설치와 장소 정책센터는 대한민국에 설치된다. 제2조 정책센터의 기능과 활동 정책센터의 기능과 활동은 다음을 포함한다.

5 가. 대한민국과 UNDP 간의 협력관계 발전과 관련한 모든 측면에 있어서 정부와의 직접적인 대화 창구로서 기능 나. 빈곤의 감소와 지속가능한 인적 개발의 달성에 있어 신흥공여국의 경험 및 접근방식 비교를 위한 지식센터로서 기능 다. 신흥공여국 간의 학습, 네트워킹, 정책대화 및 협의를 촉진하고 증진하며, 개발도상국 내 역 량 개발에 기여 제3조 법적 능력 UNDP는 정책센터를 통하여 (가)계약을 체결하고 (나)동산 및 부동산을 취득 처분하며 (다)소송을 제기하는 능력을 가진다. 제4조 정책센터에 대한 협약의 적용가능성 1. 정부가 1992년 4월 9일 이래로 당사자인 1946년 국제연합의 특권과 면제에 관한 협약 (이하 협약 이라 한다)이 정책센터를 포함한 UNDP와 그 직원, 임무수행 중인 전문가, 재산과 자산에 적용된다. 2. 정책센터의 공관 자산 및 그 밖의 다른 재산은 UNDP에 속한다. 제5조 정책센터의 인원 1. 정책센터는 국제적으로 채용된 소장이 지휘하며, 그 밖의 다른 UNDP 인력으로 구성된다. 소 장과 그 밖의 모든 UNDP 인력은 국적에 관계없이 UNDP의 직원이다. UNDP가 국제연합의 보조 기관이므로 모든 UNDP 직원은 국제연합 직원이다. 2. 직원의 등급과 수에 대해서는 정책센터의 수요와 재원의 가용여부에 따를 것을 조건으로 당사자 가 별도로 합의한다. 모든 직원은 UNDP의 규정 규칙 정책 및 절차에 따라 UNDP가 채용하고 임명한다. 3. UNDP는 직원과 그 가족의 명단 및 그 어떠한 변동사항에 대해서도 수시로 정부에 서면으로 통 보한다. 4. UNDP는 그 규정 규칙 정책 및 절차에 따라 수시로 직원 이외의 인력에 의한 서비스를 활용할 수 있다. 제6조 재원 조달 정부는 당사자가 별도로 합의하는 바에 따라 정책센터에 대한 재정 지원에 실질적으로 기여한다. 제7조 공관 및 안전 1. 가. 정책센터의 공관은 그 기능과 활동 수행을 위하여만 사용한다. 정책센터 소장은, 정책센터의 기능과 활동에 부합하는 방식으로, 정책센터를 포함한 UNDP와 다른 관련 기구가 주관하는 회 5

6 의 세미나 전시회 및 관련 목적을 위한 공관과 시설의 사용을 허가할 수 있다. 나. 신속한 보호 조치를 요하는 화재나 그 밖의 긴급 상황의 경우 소장이나 그 대리인이 적절한 시간 내에 연락이 되지 않으면, 공관 안으로의 필가피한 진입에 대한 소장이나 대리인의 동의 가 있는 것으로 간주한다. 2. 가. 적절한 정부 당국은 정책센터 공관의 안전 보호 및 평온을 보장하기 위하여 적절한 주의를 기울여야 한다. 당국은 또한 정책센터의 평온이 외부인이나 외부인 집단의 허가되지 않은 진입 또는 센터 인근의 소동에 의하여 방해받지 아니하도록 가능한 모든 조치를 취한다. 나. 앞의 내용을 침해하지 않고, 그리고 앞의 내용에도 불구하고, UNDP는 적절하고 필요하다고 간주될 경우 그 관리 기구의 결정과 결의에 따라 UNDP 및 그 직원의 안전에 관한 규율을 만 들 권한을 가진다. 3. 이 협정이나 협약에 달리 규정된 경우를 제외하고, 대한민국에서 적용가능한 법은 정책센터의 공관 안에서 적용된다. 정책센터의 공관은 UNDP의 통제와 권한 하에 있게 되며 UNDP는 센터 안에서의 기능수행을 위한 규정을 수립할 수 있다. 제8조 공공 서비스 1. 적절한 정부당국은 정책센터의 공관에 전기 상하수도 가스 우편 전화 전신 배수 폐기물수거 및 화재보호를 포함하여(여기에 열거되지 않음으로 인해 제한되지 아니한다) 필요한 모든 공공 설비 및 서비스가 제공되고 이러한 제공이 공정한 조건으로 이루어지도록 소장이 요청하는 범위까지 권한을 행사한다. 2. 그러한 서비스의 중단이나 중단 우려가 있을 경우 적절한 정부당국은 정책 센터의 수요를 대한 민국에 주재하는 외교 공관 및 다른 국제기구의 수요와 동등하게 중요한 것으로 간주하며, 정책 센터의 업무가 저해되지 아니하도록 그에 따른 조치를 취한다. 3. 소장은 요청이 있을 경우 정책센터의 기능 수행을 비합리적으로 저해하지 않는 조건 하에 적절 한 공공 서비스 기관이 정책센터 공관 안에서 설비 도관 배관 및 하수시설을 검사 보수 유지 재 건 및 재배치할 수 있도록 적절한 조치를 취한다. 제9조 통신 및 출판 1. 정책센터는 공적 통신과 관련하여 우편 전보 전신 전화, 그리고 무선 송신기를 포함한 그 밖 의 통신에 대한 우선순위 요금 및 조세, 그리고 신문 및 라디오의 정보에 대한 요금의 문제에 있어서 정부가 외교 공관이나 다른 국제기구에 부여하는 대우보다 불리하지 않은 대우를 향유한 다. 2. 정책센터나 그 직원에게 송신된 모든 공적 통신과 정책센터가 송신하는 공적 통신은 그 송신 형 태에 관계없이 검열과 그 밖의 형태의 간섭으로부터 면제된다. 3. UNDP는 정책센터를 통하여 암호를 사용하고, 외교신서사 및 외교행낭과 동일한 특권과 면제를 향유하는 신서사에 의하거나 봉인된 행낭에 담아 공적서신과 그 밖의 공적 통신을 발송하고 접수 6

7 할 권리를 가진다. 행낭은 국제연합 표장이 잘 보이도록 부착되어 있어야 하고 공적 용도의 서류 나 물품만을 담을 수 있으며, 신서사는 국제연합이 발급하는 신서사 증명서를 제공받아야 한다. 4. 정책센터는 그 기능과 활동 분야에서 학술 출판물과 연구 보고서를 생산할 수 있다. 그러나, 정 책센터는 지적재산권에 관한 대한민국의 법 및 관련 국제협약을 준수하여야 하는 것으로 양해한 다. 제10조 문 서 정책센터의 문서는 불가침이다. 제11조 기금 자산 및 다른 재산 1. 정책센터와 그 재산 및 자산은 그 소재지 및 보유자에 관계없이 모든형태의 법적 절차로부터의 면제를 향유한다. 다만, 국제연합이 명시적으로 면제를 포기하는 특별한 경우에는 예외로 한다. 그러나 어떠한 면제의 포기도 집행 조치를 포함하지는 않는 것으로 양해한다. 법적 서류의 송달 이나 집행(사적 재산의 압류를 포함한다)은 소장이 명시적으로 동의하고 소장이 승인한 조건에 의 한 경우를 제외하고는 정책센터의 공관 안에서는 행하여 지지 않는 것으로 양해한다. 앞의 내용 을 침해함이 없이 정부가 현실적으로 공관에서의 모든 송달 시도를 방지할 수는 없다는 점을 양 해한다. 2. 정책센터의 공관은 불가침이다. 정책센터의 재산과 자산은 그 소재지 및 보유자에 관계없이 집 행적 행정적 사법적 또는 입법적 조치를 통한 수색 징발 몰수 수용 및 다른 모든 형태의 간 섭으로부터 면제된다. 3. 정책센터는 어떠한 종류의 재정적 통제 규칙 또는 지불유예의 제약을 받지 아니하고, 가. 기금 또는 어떠한 종류의 통화도 보유할 수 있으며 또한 태환가능 계정을 운영할 수 있으며 나. 기금 또는 통화를 대한민국으로, 대한민국으로부터, 또는 대한민국 안에서 송금할 수 있으며, 다른 태환가능통화로 태환할 수 있다. 4. 정책센터는 그 재정적 활동을 위하여 법적으로 이용가능한 환율을 부여 받고 관련법을 준수한 다. 제12조 면 세 1. 정책센터와 그 자산 소득 및 다른 재산은, 가. 모든 직접세로부터 면제된다. 다만, 정책센터는 사실상 공공 서비스 요금에 불과한 조세로부 터의 면제는 청구하지 않는 것으로 양해한다. 나. 정책센터가 공적 사용을 위하여 수입한 물품과 관련하여 관세로부터 면제된다. 그러나, 그러 한 면제 하에 수입된 물품은 적절한 정부 당국과 합의된 조건에 따르는 경우를 제외하고는 대 한민국 안에서 판매되지 않는 것으로 양해한다. 다. 그 출판물과 관련하여 관세 및 수출입상의 금지와 제한으로부터 면제된다. 국제연합의 출판물 7

8 이 아닌 수입 간행물은 적절한 정부 당국과 합의된 조건에 따르는 경우를 제외하고는 대한민국 내에서 판매되지 아니한다. 2. 정책센터는 원칙적으로 물품세와 동산과 부동산의 판매가격에 포함되는 조세에 대하여 면제를 청구하지 아니한다. 그럼에도 불구하고 정책센터가 공적 사용을 목적으로 그러한 조세가 부과되 었거나 부과될 수 있는 재산에 대하여 중요한 구매행위를 하는 경우, 적절한 당국은 가능하다면 언제든지 조세액의 감면 또는 환급을 위한 적절한 행정 조치를 취한다. 제13조 정책센터 회의 참가자 1. 정책센터가 주관하는 회의 세미나 교육과정 심포지움 및 워크샵에 초청된 국제연합 회원국의 대표는 그 기능을 수행하는 동안 협약 제4장에 규정된 바와 같은 특권 면제를 향유한다. 2. 적절한 국제연합 원칙과 관행 및 이 협정에 의거하여, 정부는 정책센터가 주관하고 협약이 적용 될 수 있는 회의 세미나 교육과정 심포지움 및 워크샵의 모든 참가자의 완전한 표현의 자유를 존중한다. 당사자는 사안별로 적절한 경우 그러한 회의 세미나 교육과정 심포지움 및 워크샵 과 관련한 참가자 및 기능을 수행하는 사람들에게(단, 대한민국에 거주하는 대한민국 국적자는 제 외한다) 이와 관련하여 이루어진 진술 행위에 대한 법적 절차로부터 면제를 포함하여 독립적 기 능 수행을 위해 필요한 특권 면제 및 편의의 적용에 합의할 수 있다. 제14조 국제연합 기 및 표장 UNDP는 그 공관 차량 항공기 및 선박에 UNDP를 포함한 국제연합의 표장 그리고/또는 국제연 합 기를 게양 부착할 권한을 가진다. 제15조 접근 통과 및 거주 1. 정부는 정책센터의 공무상 목적으로 여행하는 자로서 다음 각 호에 언급된 모든 사람에 대하여 대한민국으로의 입국과 그로부터의 출국, 대한민국 내에서의 이동 체류에 필요한 모든 조치를 부당한 지체없이 취한다. 가. 소장 및 그 밖의 정책센터 직원, 그리고 배우자 및 부양가족 나. 정책센터의 임무를 수행중인 전문가 다. 정책센터와 공무가 있는 국제연합 전문기구 또는 국제원자력기구의 직원 라. UNDP의 관련 기금과 프로그램의 인력 및 UNDP 프로그램에 참여하는 사람 마. 정책센터가 공무로 초청한 그 밖의 사람 2. 적절한 정부 당국은 신속한 여행을 위한 편의를 부여한다. 비자 및 입국 허가는 필요할 경우 제 1항에서 언급된 모든 사람들에게 가능한 신속하게 발급된다. 제16조 신원 증명 1. 제15조제1항에서 언급된 모든 사람들은 정책센터가 발급하고 국제연합의 표준 신분증에 상응하 8

9 는 개인 신분증(이하 신분증 이라 한다)을 소지한다. 2. 적절한 정부 당국은 정책센터가 제공한 관련 정보를 접수한 후 정책센터의 직원과 그 배우자 및 부양가족에게 적절한 신분증을 발급한다. 제17조 특권과 면제 1. 가. 정책센터의 직원은, 협약 가입시 정부가 행한 유보를 침해함이 없이, 협약 제5장 및 제7장에 규정된 바와 같은 특권 면제를 부여받는다. 이들은 그 중에서도 다음을 향유한다. 1) 공적 자격으로 행한 구두 또는 서면 진술 및 모든 행위와 관련하여 법적 절차로부터 면제된 다. 그러한 면제는 정책센터에의 고용이 종료된 후로도 계속 부여된다. 2) 정책센터가 지급하는 봉급 및 수당에 대한 조세로부터 면제된다. 3) 공적 수하물에 대하여는 국가의 대표나 임무 수행중인 전문가에게만 부여되는 바와 같이 압 류로부터 면제된다. 다만 의심스러운 경우는 예외로 한다. 나. 이에 더하여, 국제적으로 채용된 정책센터 직원은 다음을 향유한다. 1) 배우자 및 부양가족과 더불어 출입국 제한과 외국인 등록으로부터 면제된다. 2) 외환편의와 관련하여 정부에 파견 등록된 동급의 외교직원이 향유하는 바와 같은 동일한 특권이 부여된다. 3) 국제적 위기시에 배우자 및 부양가족과 더불어 외교사절과 동일한 귀환 편의가 제공된다. 4) 대한민국에 최초로 부임할 때 개인 용품을 면세로 수입할 권리를 가지며 이후로는 대한민국 내에서 다른 국제연합 사무소와 동일한 권리를 가진다. 다. 정책센터를 위하여 임무를 수행중인 전문가는 협약 제6장과 제7장에 규정된 바와 같은 특권 면제 및 편의를 부여받는다. 2. 특권 면제는 국제연합의 이익을 위하여 이 협정에 따라 부여되며, 개인적 이익을 위하여 부여 되지 아니한다. 국제연합 사무총장은 면제가 사법 절차를 저해하고 국제연합의 이익을 침해함이 없이 포기할 수 있다고 판단되는 모든 경우에 있어 개인에 대한 면제를 포기할 권리와 의무를 가진다. 제18조 통행증 1. 대한민국 정부는 정책센터의 공무를 목적으로 여행중인 직원에게 발급된 국제연합 통행증을 여 권과 동등하게 유효한 여행 문서로 인정하고 수락한다. 비자와 입국 허가증은, 필요한 경우, 무료 로 그리고 가능한 신속하게 발급된다. 이에 더하여, 그러한 사람에 대하여는 신속한 여행을 위한 편의를 부여한다. 2. 국제연합 통행증의 소지자는 아니지만, 국제연합 업무로 여행 중이라는 증명서를 소지한 사람들 에게는 제1항에서 명시된 바와 같은 유사한 편의가 부여된다. 제19조 분쟁 해결 이 협정으로부터 또는 이 협정과 관련하여 발생하는 것으로서 교섭이나 그 밖의 합의된 방식에 9

10 의하여 해결되지 않는 정부와 UNDP 간의 분쟁은 어느 한 쪽 당사자의 요청에 의하여 중재에 회부 된다. 각 당사자는 중재인 1명을 임명하고 그렇게 지명된 중재인 2명은 제3의 중재인을 임명하며, 제3의 중재인이 의장이 된다. 중재 요청으로부터 30일 내에 어느 당사자가 중재인을 임명하지 않 거나 중재인 2명에 대한 임명으로부터 15일 내에 제3의 중재인이 임명되지 않을 경우, 어느 한 쪽 당사자는 국제사법재판소장에게 중재인의 임명을 요청할 수 있다. 중재 절차는 중재인들이 결정하 고, 중재 비용은 중재인들이 산정하는 대로 당사자가 부담한다. 중재 판정은 그 근거 이유에 대한 진술을 포함하여야 하며 당사자에 의하여 분쟁의 최종 판결로 수락된다. 제20조 현지 법령의 존중 1. 이 협정에 의하여 부여된 특권 면제를 침해함이 없이, 대한민국의 법령을 준수하는 것은 그러 한 특권 면제를 향유하는 모든 이들의 의무이다. 그들은 또한 대한민국의 국내 문제에 간섭하지 않을 의무가 있다. 2. 정책센터는 적절한 사법 집행을 용이하게 하고 치안 규정의 준수를 보장하며 이 협정에 따른 특 권 면제 및 편의와 관련한 어떠한 남용도 발생하지 않도록 적절한 정부 당국과 항상 협조한다. 3. 정부가 이 협정에 따라 부여된 특권이나 면제의 남용이 발생했다고 판단할 경우, 정책센터 소장 은 요청에 따라 그러한 남용이 발생하였는지 여부를 결정하기 위하여 적절한 당국과 협의한다. 그러한 협의가 정부와 정책센터 소장에게 만족스러운 결과를 도출하지 못할 경우, 해당 사안은 제19조에 명시된 절차에 따라 결정된다. 제21조 일반 조항 1. 이 협정의 조항들은 협약의 조항을 보완한다. 즉 이 협정 조항과 협약조항이 동일한 문제와 관 련된 경우, 그 두 조항은 두 조항 모두 적용가능하며 어떠한 조항도 다른 한 쪽 조항의 효력을 제한하지 않도록 보완적인 것으로 간주한다. 2. 이 협정은 양 당사자가 이 협정의 발효를 위한 각각의 내부절차가 완료되었음을 상호 다른 쪽 당사자에게 통보하는 날에 발효한다. 3. 어느 한 쪽 당사자의 요청에 따라 이 협정의 개정을 목적으로 하는 협의를 가질 수 있다. 어떠 한 개정도 상호 서면 동의로 이루어질 수 있다. 4. 정부와 UNDP는 필요할 경우 보충 약정을 체결할 수 있다. 이 협정에 관련 조항이 없는 사안은 당사자 간의 협의를 통하여 해결한다. 5. 당사자는 정책센터의 운영으로부터 3년 후, 당시 존재하고 예상되는 사무조직과 활동을 감안하 여 이 협정을 검토한다. 6. 대한민국 내에서 정책센터 활동의 정상적 중단과 그 재산의 처분, 그리고 당사자 간 분쟁의 해 결과 관련된 경우를 제외하고, 이 협정은 어느 한 쪽 당사자가 다른 쪽 당사자에게 협정 종료 결 정을 서면으로 통보한 지 6개월 후에 효력을 상실한다. 이상의 증거로, 아래 서명자는 각각 정부와 UNDP로부터 정당하게 권한을 위임받아 이 협정에 서 10

11 명하였다. 이 협정은 2009년 11월 23일 서울에서 영어로 원본 2부에 서명되었다. 대한민국 정부를 대표하여 국제연합개발계획을 대표하여 AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE UNITED NATIONS DEVELOPMENT PROGRAMME RELATING TO THE ESTABLISHMENT OF THE UNDP SEOUL POLICY CENTER FOR GLOBAL DEVELOPMENT PARTNERSHIPS The Government of the Republic of Korea (hereinafter referred to as the Government ) and the United Nations Development Programme (hereinafter referred to as the UNDP ) (hereinafter jointly referred to as the Parties ); WHEREAS UNDP is a subsidiary organ of the United Nations, established by General Assembly resolution 2029 of 22 November 1965; WHEREAS the Parties concluded an Agreement relating to UNDP s assistance to the Government on 14 December 1978 (hereinafter referred to as the SBAA ), which is terminated by notice from the Government to UNDP in accordance with the terms of the SBAA on 1 January 2010; WHEREAS the Government s partnership with UNDP has evolved over time with the conclusion of the Partnership Framework Agreement signed between the Parties on 25 April 2006, and with the establishment of a thematic MDG Trust Fund funded by the Government to commence from the year 2010; and WHEREAS UNDP is interested in establishing in the Republic of Korea a Policy Center on Global Development Partnerships (hereinafter referred to as the Policy Center ) and the Government has agreed to the establishment of such a Policy Center in the Republic of Korea, and further agrees to grant UNDP all the necessary privileges, immunities, and facilities to enable the Policy Center to perform its functions; NOW, THEREFORE, the Parties hereby agree as follows: Article 1 Establishment and Location The Policy Center is established in the Republic of Korea. Article 2 Functions and Activities of the Policy Center The functions and activities of the Policy Center shall include the following: (a) to serve as the immediate interface with the Government on all aspects relating to 11

12 the evolving Republic of Korea-UNDP partnership; (b) to serve as a knowledge center for comparative experiences and approaches of new development partners in reducing poverty and achieving sustainable human development; and (c) to facilitate and promote learning, networking, policy dialogue and consultation among new development partners and to contribute to capacity development in developing countries. Article 3 Legal Capacity UNDP, acting through the Policy Center, shall have the capacity: (a) to contract; (b) to acquire and dispose of movable and immovable property; and (c) to institute legal proceedings. Article 4 Applicability of the Convention to the Policy Center 1. The Convention on the Privileges and Immunities of the United Nations of 1946 (hereinafter referred to as the Convention ), to which the Government has been a party since 9 April 1992, shall apply to UNDP, including the Policy Center, its officials and experts on mission, property and assets. 2. The premises, assets and other property of the Policy Center belong to UNDP. Article 5 Policy Center Personnel 1. The Policy Center shall be headed by an internationally-recruited Director, and shall be comprised of other UNDP staff. Both the Director and all other UNDP staff are UNDP officials, irrespective of nationality. As UNDP is a subsidiary organ of the United Nations, all UNDP officials are UN officials. 2. The level and number of officials shall be agreed upon separately by the Parties, subject to the needs of the Policy Center and the availability of financial resources. All officials shall be recruited and appointed by UNDP in accordance with its regulations, rules, policies and procedures. 3. UNDP shall notify the Government, from time to time, in writing, of the list of the officials and their families and any change thereto. 4. From time to time, UNDP may engage the services of non-staff personnel in accordance with UNDP regulations, rules, policies and procedures. Article 6 Financing The Government will contribute substantially to financing the Policy Center, as shall be 12

13 separately agreed between the Parties. Article 7 Premises and Security 1. (a) The premises of the Policy Center shall be used solely to further its functions and activities. The Director of the Policy Center may also permit, in a manner compatible with the functions and activities of the Policy Center, the use of the premises and facilities for meetings, seminars, exhibitions and related purposes which are organized by UNDP, including the Policy Center, and other related organizations. (b) In case of fire or other emergency requiring prompt protection action, the consent of the Director or his/her representative to any necessary entry into the premises shall be presumed if neither of them can be reached in time. 2. (a) The appropriate authorities of the Government shall exercise due diligence to ensure the security, protection and tranquility of the premises of the Policy Center. They shall also take all possible measures to ensure that the tranquility of the Policy Center is not disturbed by the unauthorized entry of persons or groups of persons from outside or by disturbances in its immediate vicinity. (b) Without prejudice to and notwithstanding the foregoing, UNDP shall have the right to make any provisions relating to its security and the security of its personnel as it deems relevant and necessary in accordance with decisions and resolutions of its governing bodies. 3. Except as otherwise provided in the Agreement or in the Convention, the laws applicable in the Republic of Korea shall apply within the premises of the Policy Center. The premises of the Policy Center shall be under the control and authority of UNDP, which may establish regulations for the execution of its functions therein. Article 8 Public Services 1. The appropriate authorities of the Government shall exercise, to the extent requested by the Director, their respective powers to ensure that the premises of the Policy Center are supplied with the necessary public utilities and services, including, without limitation by reasons of this enumeration, electricity, water, sewerage, gas, post, telephone, telegraph, drainage, collection of refuse and fire protection, and that such public utilities and services are supplied on equitable terms. 2. In case of any interruption or threatened interruption of any such services, the appropriate authorities of the Government shall consider the needs of the Policy Center as being of equal importance with the needs of diplomatic missions and other 13

14 international organizations in the Republic of Korea, and shall take steps accordingly to ensure that the work of the Policy Center is not prejudiced. 3. The Director shall, upon request, make suitable arrangements to enable the appropriate public service bodies to inspect, repair, maintain, reconstruct and relocate utilities, conduits, mains and sewers within the premises of the Policy Center under conditions that shall not unreasonably disturb the carrying out of the functions of the Policy Center. Article 9 Communications and Publications 1. The Policy Center shall enjoy, in respect of its official communications, treatment not less favorable than that accorded by the Government to any diplomatic mission or other intergovernmental organizations in matters of priorities, rates and taxes on mails, cables, telegrams, telephone and other communications, including wireless transmitters, as well as rates for information to the press and radio. 2. All official communications directed to the Policy Center, or to any of its officials, and outward official communications of the Policy Center, by whatever form transmitted, shall be immune from censorship and from any other form of interference. 3. UNDP, acting through the Policy Center, shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags, which shall have the same privileges and immunities as diplomatic couriers and bags. The bags must bear visibly the United Nations emblem and may contain only documents or articles intended for official use, and the courier should be provided with a courier certificate issued by the United Nations. 4. The Policy Center may produce research reports as well as academic publications within the fields of its functions and activities. It is, however, understood that the Policy Center shall abide by the laws of the Republic of Korea concerning intellectual property rights in the Republic of Korea and related international conventions. Article 10 Archives The archives of the Policy Center shall be inviolable. Article 11 Funds, Assets and Other Property 1. The Policy Center, its property and assets, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except insofar as in any particular case the United Nations has expressly waived the immunity. It is, however, 14

15 understood that no waiver of immunity shall extend to any measure of execution. It is understood that no service or execution of any legal process, including the seizure of private property, shall take place within the premises of the Policy Center except with the express consent of and under conditions approved by the Director. Without prejudice to the preceding sentence, it is understood that, as a practical matter, the Government cannot prevent all attempts at service of process in the premises. 2. The premises of the Policy Center shall be inviolable. The Policy Center s property and assets, wherever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action. 3. Without being restricted by financial controls, regulations, or moratoria of any kind, the Policy Center may: (a) hold funds or currency of any kind and operate accounts in convertible currencies; (b) transfer its funds or currency to and from the Republic of Korea or within the Republic of Korea and convert them into other freely convertible currency. 4. The Policy Center shall be accorded the legally available rate of exchange for its financial activities and abide by related laws. Article 12 Exemption from Taxation 1. The Policy Center and its assets, income and other property shall be: (a) exempt from all direct taxes. It is understood, however, that the Policy Center shall not claim exemption from taxes which are, in fact, no more than charges for public utility services; (b) exempt from customs duties in respect of articles imported by the Policy Center for its official use. It is understood, however, that articles imported under such exemption shall not be sold in the Republic of Korea except under conditions agreed with the appropriate authorities of the Government; (c) exempt from customs duties and prohibitions and restrictions on imports and exports in respect of its publications. Imported publications, other than those of the United Nations, shall not be sold in the Republic of Korea except under conditions agreed with the appropriate authorities of the Government. 2. While the Policy Center shall not, as a general rule, claim exemption from excise duties and from taxes on the sale of movable and immovable property that form part of the price to be paid, nevertheless, when the Policy Center is making important purchases for official use of property on which such duties and taxes have been 15

16 charged or are chargeable, the appropriate authorities shall, whenever possible, make appropriate administrative arrangements for the remission or return of the amount of the duty or tax. Article 13 Participants in the Policy Center s Meetings 1. Representatives of Members of the United Nations invited to meetings, seminars, training courses, symposiums and workshops organized by the Policy Center shall, while exercising their functions, enjoy the privileges and immunities as set out in Article IV of the Convention. 2. The Government, in accordance with relevant United Nations principles and practices and the present Agreement, shall respect the complete freedom of expression of all participants of meetings, seminars, training courses, symposiums and workshops organized by the Policy Center, to which the Convention shall be applicable. On a case by case basis, the Parties may, if appropriate, agree on the application of the privileges and immunities and facilities as are necessary for participants and persons performing functions, other than Government nationals resident in the Republic of Korea, in connection with such meetings, seminars, training course, symposiums and workshops, for the independent exercise of their functions, including immunity from legal process in respect of words spoken and acts done in connection therewith. Article 14 Flag and Emblem UNDP shall have the right to display the emblem of the United Nations, including UNDP, and/or the flag of the United Nations on its premises, vehicles, aircraft and vessels. Article 15 Access, Transit and Residence 1. The Government shall take all necessary measures to facilitate the entry into and exit from, and movement and sojourn within, the Republic of Korea for all persons referred to below, traveling for the purpose of official business of the Policy Center without undue delay: (a) The Director and other officials of the Policy Center, as well as their spouses and relatives dependent on them; (b) Experts on mission for the Policy Center; (c) Officials of the United Nations or specialized agencies or of the International Atomic Energy Agency, having official business with the Policy Center; 16

17 (d) Personnel of associated funds and programmes of UNDP and persons participating in the programmes of UNDP; (e) Other persons invited by the Policy Center on official business. 2. The appropriate authorities of the Government shall grant facilities for speedy travel. Visas and entry permits, where required, shall be issued as promptly as possible to all persons referred to in paragraph 1. Article 16 Identification 1. Persons referred to in Article 15(1) shall hold a personal identity card (hereinafter referred to as the IDs ) issued by the Policy Center which is equivalent to a standard United Nations identity card. 2. The relevant authorities of the Government shall issue appropriate IDs to the officials of the Policy Center and their spouses and relatives dependent on them after receiving their relevant information provided by the Policy Center. Article 17 Privileges and Immunities 1. (a) Officials of the Policy Center shall be accorded the privileges and immunities provided for in Articles V and VII of the Convention, without prejudice to the reservation made by the Government upon accession thereto. They shall, inter alia, enjoy: I. immunity from legal process in respect of words spoken or written and all acts performed by them in their official capacity; such immunity shall continue to be accorded after termination of employment with the Policy Center; ii. exemption from taxation on the salaries and emoluments paid to them by the Policy Center; iii. immunity from seizure of their official baggage, except in doubtful cases, granted only to representatives of States and experts on mission. (b) In addition, internationally-recruited officials of the Policy Center shall: I. be immune, together with their spouses and relatives dependent on them, from immigration restrictions and alien registration; ii. be accorded the same privileges in respect of exchange facilities as those enjoyed by members of comparable rank of the diplomatic staff of missions accredited to the Government; iii. be given, together with their spouses and relatives dependent on them, the same repatriation facilities in times of international crisis as diplomatic envoys; 17

18 iv. have the right to import free of duty their personal effects at the time of first taking up their posts in the Republic of Korea and to enjoy, thereafter, the same privileges as other United Nations offices in the Republic of Korea. (c) Experts on mission for the Policy Center shall be granted the privileges and immunities and facilities provided for in Articles VI and VII of the Convention. 2. Privileges and immunities are granted by this Agreement in the interests of the United Nations and not for the personal benefit of the individuals themselves. The Secretary- General of the United Nations shall have the right and the duty to waive the immunity of any individual in any case where, in the Secretary-General s opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the United Nations. Article 18 Laissez-Passer 1. The Government of the Republic of Korea shall recognize and accept the United Nations laissez-passer issued to officials traveling for the purpose of official business of the Policy Center as a valid travel document equivalent to a passport. Visas and entry permits, where required, shall be granted free of charge and as speedily as possible. In addition, such persons shall be granted facilities for speedy travel. 2. Similar facilities as specified in paragraph 1 above shall be accorded to persons who, though not holders of a United Nations laissez-passer, have a certificate that they are traveling on the business of the United Nations. Article 19 Settlement of Disputes Any dispute between the UNDP and the Government arising out of or relating to this Agreement which is not settled by negotiation or other agreed mode of settlement shall be submitted to arbitration at the request of either Party. Each Party shall appoint one arbitrator, and the two arbitrators so appointed shall appoint a third, who shall be the Chairperson. If within thirty days of the request for arbitration either Party has not appointed an arbitrator, or if within fifteen days of the appointment of two arbitrators the third arbitrator has not been appointed, either Party may request the President of the International Court of Justice to appoint an arbitrator. The procedure of the arbitration shall be fixed by the arbitrators, and the expenses of the arbitration shall be borne by the Parties as assessed by the arbitrators. The arbitral award shall contain a statement of the reasons on which it is based and shall be accepted by the Parties as the final adjudication of the dispute. 18

19 Article 20 Respect for Local Laws and Regulations 1. Without prejudice to the privileges and immunities accorded by this Agreement, it is the duty of all persons enjoying such privileges and immunities to observe the laws and regulations of the Republic of Korea. They also have a duty not to interfere in the internal affairs of the Republic of Korea. 2. The Policy Center shall cooperate at all times with the appropriate authorities of the Government to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuse in connection with the privileges and immunities and facilities under the Agreement. 3. Should the Government consider that an abuse of a privilege or immunity conferred by this Agreement has occurred, the Director of the Policy Center shall, upon request, consult with the appropriate authorities to determine whether any such abuse has occurred. If such consultations fail to achieve a result satisfactory to the Government and to the Director of the Policy Center, the matter shall be determined in accordance with the procedures set out in Article 19. Article 21 General Provisions 1. The provisions of this Agreement shall be complementary to the provisions of the Convention, i.e., in so far as any provisions of this Agreement and any provisions of the Convention relate to the same subject matter, the two provisions shall be treated as complementary, so that both provisions shall be applicable and neither shall narrow the effect of the other. 2. This Agreement shall enter into force on the date when the Parties have notified each other of the completion of their respective internal procedures for the entry into force of this Agreement. 3. Consultations with a view to amending this Agreement may be held at the request of either Party. Any amendments may be made by mutual consent, in writing. 4. The Government and UNDP may enter into such supplementary arrangements as shall be necessary. Any relevant matter for which no provision is made in this Agreement shall be settled through consultations between the Parties. 5. This Agreement shall be reviewed by the Parties after three years of operation of the Policy Center, taking into consideration its then existing and anticipated office structure and activities. 6. The Agreement shall cease to be in force six (6) months after either of the Parties 19

20 give notice in writing to the other of its decision to terminate the Agreement, except as regards the normal cessation of the activities of the Policy Center and the disposal of its property in the Republic of Korea, as well as the resolution of any disputes between the Parties. IN WITNESS WHEREOF, the undersigned, duly authorized respectively by the Government and the UNDP, have signed this Agreement. This Agreement is hereby signed in two original copies at Seoul on 23rd November 2009, in the English language. FOR THE GOVERNMENT OF THE REPUBLIC OF KOREA FOR THE UNITED NATIONS DEVELOPMENT PROGRAMME 2008년 7월 22일 제 30회 국무회의 심의를 거쳐 2009년 3월 23일 서울에서 유명환 외교통 상부장관과 미겔 앙헬 모라띠노스 꾸야우베(Miguel Angel Moratinos Cuyaube) 스페인 외 교협력부장관 간에 서명된 후, 양국이 발효에 필요한 국내절차가 완료되었음을 상호 통보함으로써 2010년 1월 5일자로 발효된 대한민국과 스페인왕국 간의 군사비밀보호에 관한 협정 을 이에 공 포한다. 대 통 령 국 무 총 리 국 무 위 원 외교통상부 장 관 이 명 박 정 운 찬 유 명 환 조약 제1987호 대한민국과 스페인왕국 간의 군사비밀보호에 관한 협정 대한민국과 스페인왕국(이하 당사자 라 한다)은, 국방 분야에서의 협력을 바라며, 이 협정에 따라 교환되는 비밀정보의 보호를 보장할 것을 희망하면서, 다음과 같이 합의하였다. 제1조 목 적 이 협정은 각 당사자의 법령에 따라 당사자 간에 교환된 국방 관련 비밀정보의 보호를 위한 보안 원칙의 적용에 관한 절차를 명시한다. 제2조 정 의 이 협정의 목적상 20

21 1. 비밀정보 란 어느 한 쪽 당사자의 국내 법령에 따라 그 당사자의 권한 있는 당국에 의하여 비 밀로 분류되고 권한을 위임받지 아니한 공개로부터의 보호를 필요로 하는 모든 유형의 군사 관련 정보와 자료를 말한다. 2. 비밀계약 이란 당사자 간에 집행 가능한 권리와 의무를 창출하고 정의하며 비밀정보에의 접근 을 필요로 하는 둘 또는 그 이상의 계약자들 간의 합의를 말한다. 3. 계약자 란 계약을 체결할 법적 능력을 가진 개인이나 법인을 말한다. 4. 제공당사자 란 비밀정보를 생산하는 당사자를 말한다. 5. 접수당사자 란 다른 쪽 당사자로부터 비밀정보를 전달받는 당사자를 말한다. 6. 제3자 란 이 협정에 대한 당사자가 아닌 사람, 기관, 국제또는 국가조직, 공적 또는 사적 단체 나 국가를 말한다. 7. 개인보안허가증 이란 어느 한 쪽 당사자의 권한 있는 당국이 부여한 것으로서 그 당사자의 국 내 보안법령에 따라 어느 개인에게 비밀정보에의 접근이 허가될 수 있음을 증명하는 문서를 말한 다. 8. 시설보안허가증 이란 어느 회사/설립물이 국내 보안법령에 따라 비밀정보를 보호할 물리적이고 조직적인 능력을 가지고 있음을 증명하는 문서를 말한다. 제3조 보안분류등급 1. 비밀정보는 전달되기 전 다음과 같이 적절한 보안분류등급을 부여받는다. 한국 분류 영어 해당 분류 스페인 분류 군사 Ⅱ급 비밀 SECRET Reservado 군사 Ⅲ급 비밀 CONFIDENTIAL Confidencial 군사 대외비 RESTRICTED Difusion Limitada 2. 접수당사자는 제공당사자로부터 접수하는 비밀정보에 이조 제1항에 따라 동일한 국가 보안분류 등급이 표시되도록 보장한다. 3. 제공당사자에 의하여 전달되는 비밀정보를 재생산하거나 발췌하는 경우 접수당사자는 그러한 복 사본에 제공당사자의 보안분류등급에 따른 등급을 표시한다. 4. 접수당사자는 제공당사자의 사전 서면동의가 없이는 제공당사자가 지정한 보안분류등급을 변경 하지 아니한다. 5. 제공당사자는 접수당사자에게 비밀정보의 보안분류등급 변경 사실을 통보한다. 이 경우 접수당 사자는 그에 따라 비밀정보를 재분류한다. 당사자 간에 교환되는 비밀정보의 최고 등급은 군사 II 급 비밀/SECRET/RESERVADO 로 한다. 제4조 권한 있는 보안당국 1. 이 협정의 이행을 책임지는 권한 있는 보안당국은 다음과 같다. 21

22 가. 대한민국의 경우에는 국방부 국방정보본부장 나. 스페인왕국의 경우에는 국가정보센터장 보좌관 2. 각 당사자는 이 협정의 이행에 관한 모든 요건 및 절차에 관하여 다른 쪽 당사자와조율하기 위 하여 적절한조치를 취한다. 제5조 비밀정보에 대한 접근 1. 이 협정에 따라 교환된 비밀정보에의 접근은 다음 사람에게 제한된다. 가. 이 협정에 따른 비밀 사업과 관련하여 공적 또는 직업적 임무 수행을 위하여 정보에 대한 접 근을 필요로 하고, 나. 권한 있는 보안당국이 발급한 적절한 개인보안허가증을 소지하며, 다. 국내 법령 및 이 협정의 규정에 따라 비밀정보를 보호할 책임을 통지받았고, 라. 각 당사자의 국내 법령에 따라 각 계약에 포함된 비밀정보에 대한 접근 권한을 보유하고 있 는 자 2. 다른 쪽 당사자의 국가 영역에 합법적으로 거주하고 그 국가 영역에서 비밀정보에의 접근과 관 련된 직업에 지원하는 어느 한 쪽 당사자의 국민에 대한 개인보안허가는 그 당사자의 권한 있는 보안당국에 의하여 행하여진다. 필요할 경우, 그 국민의 출신 당사자는 다른 쪽 당사자의 심사 과 정에 협력하기 위하여 보안 허가 대상인 그 국민에 관한 정보를 제공한다. 3. 양 당사자가 상호 관심을 가지고 있는 비밀 국방사업의 범주 내에서 어느 한 쪽 당사자의 권한 있는 보안당국이 발급한 개인보안허가증은 다른 쪽 당사자가 수용한다. 제6조 비밀정보의 보호 1. 접수당사자는 다른 쪽 당사자로부터 접수한 모든 비밀정보에 대하여 이 협정 제3조에 정의된 바 에 따라 동일한 분류등급의 자국 비밀정보에 제공되는 것과 동일한 보호를 제공한다. 2. 어느 당사자도 제공당사자의 사전 서면 동의 없이는 제3자에게 비밀정보를 공개ㆍ발표하거나 비 밀정보에 대한 접근을 제공하지 아니한다. 3. 접수당사자는 제공당사자의 사전 서면 동의 없이는 비밀정보가 제공된 목적과 다른 목적으로 사 용되도록 허용하지 아니한다. 4. 각 당사자는 비밀정보에 존재하는 특허권, 저작권 또는 무역 비밀과 같은 사적 권리가 존중받도 록 보장한다. 제7조 비밀정보의 전달 1. 당사자가 상호 달리 결정하지 아니하는 한, 비밀정보 전달을 위한 통상적인 절차는 군사 또는 외교 경로를 통하도록 한다. 그러한 경로의 이용이 실행 불가능하거나 비밀정보 접수의 부당한 22

23 지연을 야기하는 경우에는 정보를 전달하는 당사자가 발급한 운송 인증서를 소지하고 적절한 보 안허가를 받은 직원이 전달할 수 있다. 2. 당사자는 양 당사자가 상호 결정한 보안 절차에 따라 비밀정보를 전자적인 수단에 의하여 전달 할 수 있다. 제8조 보안 기준에 관한 세부 사항 유사한 보안 기준을 달성하고 유지하기 위하여 각 당사자는 요청이 있을 경우 다른 쪽 당사자에 게 비밀정보를 보호하기 위한 보안 관행에 관한 정보를 제공하며, 필요하다고 간주될 경우에는 그 러한 관행에 대한 협의를 위하여 다른 쪽 당사자의 권한 있는 보안당국 대표자의 방문을 용이하게 한다. 제9조 방 문 1. 비밀정보 또는 비밀정보를 취급하는 다른 쪽 당사자 계약자의 시설에 대한 접근을 요구하는 어 느 한 쪽 당사자 직원의 방문은 반드시 방문 대상인 당사자의 권한 있는 보안당국의 사전 승인을 얻은 후에 행하여진다. 2. 방문 요청에는 다음과 같은 정보를 포함한다. 가. 방문자 성명, 생년월일 및 출생지, 국적 및 여권 번호 나. 방문자 공식 직함, 방문자가 대표하는 설립물ㆍ회사 또는 기관의 명칭 다. 방문 당사자의 권한 있는 보안당국이 방문자에게 발급한 개인보안허가증의 확인서 라. 방문 예정일자. 재방문의 경우에는 전체 방문 기간이 명시되어야 한다. 마. 방문 목적 바. 접근할 비밀정보의 예상 분류등급 사. 정부 주도의 방문인지 또는 상업적 목적의 방문인지 여부 아. 방문이 요청하는 설립물 시설 또는 기관에 의하여 주도된 것인지 또는 방문 대상인 설립물 시설 또는 기관에 의하여 주도된 것인지 여부 자. 방문 대상인 설립물 회사 또는 기관의 명칭과 주소 차. 방문 대상인 사람들의 성명과 지위, 그리고 가능할 경우 전화번호 3. 방문 요청은 요청된 방문일로부터 적어도 20일 전에 방문 대상인 당사자의 권한 있는 보안당국 에 제출한다. 4. 당사자는 방문 요청의 절차 관리 및 감독을 담당하는 당국을 서면으로 상호 통보한다. 5. 긴급한 경우, 요청은 요청된 방문일로부터 적어도 5일 전에 전자 수단으로 전달될 수 있다. 6. 특정 비밀 사업 또는 계약과 관련되어 있는 특정 설립물 시설 또는 기관에 대한 재방문을 포함 한 방문 요청은 12개월을 초과하지 아니하는 기간 내에서 행할 수 있다. 특정 방문이 승인된 기 간 내에 완료되지 아니하거나 재방문을 위한 기간 연장이 필요하다고 예상되는 경우, 방문 당사 자는 이조에 명시된 절차에 따라 새로운 방문 요청을 제출한다. 23

24 7. 방문 대상인 당사자의 권한 있는 보안당국은 방문 대상인 설립물 시설 또는 기관의 보안 담당 관에게 방문이 승인된 사람들에 관한 정보를 통보한다. 재방문이 승인된 사람들에 대한 방문 주 선은 관련 설립물 시설 또는 기관의 보안담당관과 직접 이루어질 수 있다. 8. 모든 방문자는 방문 대상인 당사자의 보안 규정을 준수한다. 제10조 비밀 계약 1. 다른 쪽 당사자의 계약자와 비밀 계약에 서명하고자 하거나 자국의 계약자가 다른 쪽 당사자의 계약자와 비밀 계약을 서명하도록 또는 협력하도록 권한을 위임하고자 하는 당사자는 제안된 계 약자가 적정 수준의 시설보안허가증을 부여받았으며 비밀 계약에 관련된 사람들이 적절한 개인보 안허가증을 소지하고 있음을 인증하도록 다른 쪽 당사자에게 요청한다. 2. 당사자의 권한 있는 보안당국은 특히 철회 또는 등급 하향조정의 경우를 포함하여 개인 및 시설 보안허가증에 관한 변경사항을 상호 통보한다. 3. 이 협정의 규정에 따라 서명된 각 비밀계약은 다음 내용을 담은 보안 부속서를 포함한다. 가. 비밀정보의 분류 지침과 목록 나. 비밀정보의 등급 변경을 통보하는 절차 다. 전자 전송을 위한 통신 경로 및 수단 라. 운송 절차 마. 비밀계약에서 상정하는 보안의조정을 담당할 관련 당국 4. 달리 명시되는 아니하는 한, 계약과 그 보안 부속서가 만료되는 때에 제공당사자는, 전술한 보안 부속서 만료 이후에도 접수당사자에 의하여 생산되는 자료의 취급과 유지를 위하여 그 정보가 필 요할 것으로 판단하지 아니하는 한, 적절하다고 판단할 경우 정보의 반환을 요청할 수 있다. 제11조 보안 위반 비밀정보가 분실되거나 권한을 위임받지 아니한 사람에게 공개되었을 경우 접수당사자는 즉시 제 공당사자에게 통보하며 분실 또는 권한을 위임받지 아니한 공개에 대한조사를 실시한다. 제공당사 자는 필요할 경우 그러한조사에 협력한다. 제공당사자는조사의 결과 및 이미 취하여지거나 앞으로 취하여질 시정조치를 통보받는다. 제12조 분쟁 해결 1. 이 협정의 해석 또는 이행으로부터 발생하는 분쟁은 당사자 간의 상호 협의에 의하여 우호적으 로 해결된다. 2. 제1항에 따라 분쟁을 해결하는 동안 양 분쟁 당사자는 이 협정에 따른 의무를 계속 이행한다. 제13조 경 비 1. 이 협정의 이행에는 일반적으로 어떠한 비용도 따르지 아니한다. 24

25 2. 비용이 발생하는 경우 각 당사자는 이 협정을 이행함에 있어 발생하는 자신의 비용을 부담한다. 제14조 최종 규정 1. 이 협정은 발효를 위한 모든 법적 요건이 완료되었다는 나중의 서면 통보를 접수하는 날에 발효 한다. 2. 이 협정은 당사자의 상호 서면 동의에 의하여 개정될 수 있다. 3. 이 협정은 최초 5년의 기간 동안 유효하며, 추가적인 2년의 기간씩 자동적으로 연장된다. 어느 한 쪽 당사자는 다른 쪽 당사자에게 6개월 전에 사전 서면 통지함으로써 이 협정을 종료시킬 수 있다. 4. 이 협정이 종료될 경우, 제공당사자가 접수당사자에게 정보의 비밀 해제를 통보하지 아니하는 한 이 협정의 유효기간 중에 전달된 정보는 계속 이 협정에 따라 취급된다. 5. 이 협정은 비밀정보의 보호에 관한 당사자 간의 그 밖의 다른 구두 또는 서면 합의를 대체한다. 이상의 증거로, 아래 서명자들은 정당하게 권한을 위임받아 이 협정에 서명하였다. 2009년 3월 23일 서울에서 동등하게 정본인 한국어, 스페인어 및 영어로 각 2부씩 작성하였다. 대한민국을 대표하여 스페인왕국을 대표하여 AGREEMENT BETWEEN THE REPUBLIC OF KOREA AND THE KINGDOM OF SPAIN ON THE PROTECTION OF DEFENSE CLASSIFIED INFORMATION The Republic of Korea and the Kingdom of Spain (hereinafter referred to as the Parties ) Desiring to co-operate in the field of defense, and Wishing to ensure the protection of Classified Information exchanged under this Agreement, Have agreed as follows: Article 1 Purpose This Agreement sets out procedures, under the laws and regulations of each Party, regarding the application of security principles for the protection of Classified Information related to defense exchanged between the Parties. Article 2 Definitions For the purpose of this Agreement: 1. Classified Information means any defense related information and material of all types classified by the competent authorities of one Party according to its national 25

26 laws and regulations, which require protection against unauthorized disclosure; 2. Classified Contracts means agreements between two or more Contractors creating and defining enforceable rights and obligations between them, which require access to Classified Information; 3. Contractor means any individual or legal entity possessing the legal capacity to conclude contracts; 4. Originating Party means the Party that produces Classified Information; 5. Receiving Party means the Party to which Classified Information is transmitted from the other Party; 6. Third Party means any person, institution, international or national organization, public or private entity or State that is not a Party to this Agreement; 7. Personal Security Clearance means the document granted by the competent authorities of one Party proving that a person may be allowed access to Classified Information, in accordance with that Party s national security laws and regulations; 8. Facility Security Clearance means the document proving that a company/ establishment has the physical and organizational capability to safeguard Classified Information, in accordance with national security laws and regulations. Article 3 Security Classification Levels 1. Classified Information shall be assigned, before transmission, the appropriate security classification level as follows: Korean Classification Equivalence in English Spanish Classification 군사Ⅱ급 비밀 SECRET RESERVADO 군사 Ⅲ급 비밀 CONFIDENTIAL CONFIDENCIAL 군사 대외비 RESTRICTED DIFUSION LIMITADA 2. The Receiving Party shall ensure that Classified Information received from the Originating Party is marked with an equivalent national security classification level in accordance with paragraph 1 of this Article. 3. In case of reproduction or extraction of Classified Information transmitted by the Originating Party, the Receiving Party shall mark such copy in accordance with the security classification level of the Originating Party. 4. The Receiving Party shall not alter the security classification level assigned by the Originating Party without the prior written consent of the Originating Party. 26

27 5. The Originating Party shall inform the Receiving Party of any change in the security classification level of its Classified Information. The Receiving Party shall then reclassify the Classified Information accordingly. The maximum level of Classified Information exchanged between the Parties shall be 군사 Ⅱ급 비밀 /SECRET / RESERVADO. Article 4 Competent Security Authorities 1. The Competent Security Authorities responsible for the implementation of this Agreement are the following: a. For the Republic of Korea: Director, Defense Intelligence Agency, Ministry of National Defense b. For the Kingdom of Spain: Secretary of State Director of the National Intelligence Center 2. Each Party shall take the appropriate measure to co-ordinate with the other Party regarding all the requirements and procedures related to the implementation of this Agreement. Article 5 Access to Classified Information 1. Access to the Classified Information exchanged pursuant to this Agreement shall be limited to those persons who: (a) require access to the information for the performance of their official or professional duties in relation to a classified project under this Agreement; (b) hold the appropriate Personal Security Clearance issued by the Competent Security Authorities; (c) have been informed of their responsibilities to protect Classified Information according to their national laws and regulations and the provisions of this Agreement; and (d) have the authorization for access to Classified Information in each Contract in accordance with the national laws and regulations of each Party. 2. Personal Security Clearance for nationals of one Party who are legally resident in the national territory of the other Party and apply for a job in that national territory involving access to Classified Information shall be conducted by the Competent Security Authority of that Party. If required, the Party of his/her origin shall provide information regarding those nationals to be cleared in order to co-operate in the vetting process of the other Party. 27

28 3. In the scope of classified defense projects of mutual interest to both Parties, a Personal Security Clearance issued by the Competent Security Authority of one Party shall be accepted by the other Party. Article 6 Protection of Classified Information 1. The Receiving Party shall afford to all Classified Information received from the other Party the same protection as is provided to its own Classified Information of an equivalent level of classification, as defined in Article 3 of this Agreement. 2. Neither Party shall disclose, release or provide access to Classified Information to a Third Party without the prior written consent of the Originating Party. 3. The Receiving Party shall not permit Classified Information to be used for any purpose other than that which is provided for without the prior written consent of the Originating Party. 4. Each Party shall ensure that any private rights such as patents, copyrights or trade secrets that subsist in Classified Information are respected. Article 7 Transmission of Classified Information 1. Unless otherwise mutually determined by the Parties, the normal procedure for transmission of Classified Information shall be through military or diplomatic channels. If the use of such channels is impractical or causes unduly delayed receipt of the Classified Information, transmissions may be undertaken by appropriately security cleared personnel furnished with a courier certificate issued by the Party transmitting the information. 2. The Parties may transmit Classified Information by electronic means in accordance with security procedures mutually determined by the Parties. Article 8 Details of Security Standards In order to achieve and maintain comparable standards of security, each Party shall provide to the other Party, on request, information about its security practices for safeguarding Classified Information and, if considered necessary, shall facilitate visits by representatives of the other Party s Competent Security Authority for consultation on those practices. Article 9 Visits 1. Visits by personnel of a Party requiring access to Classified Information or to the 28

29 facilities of a Contractor of the other Party where Classified Information is handled shall be undertaken only with the prior approval of the Competent Security Authority of the host Party. 2. Requests for Visits shall include the following information: (a) name of the visitor, date and place of birth, nationality and passport number; (b) official title of the visitor, and the name of the establishment, company or organization which he or she represents; (c) a certification of the Personal Security Clearance of the visitor by the Competent Security Authority of the visiting Party; (d) scheduled date of the visit. In case of recurring visits, the total period covered by the visits should be stated; (e) purpose of the visit; (f) the anticipated classification level of the Classified Information to be accessed; (g) whether the visit is a government initiative or commercial initiative; (h) whether the visit is being initiated by the requesting establishment, facility or organization or by the establishment, facility or organization being visited; (i) name and address of the establishment, company or organization to be visited; and (j) names, status and, if possible, telephone numbers of the people to be visited. 3. Requests for Visits shall be submitted at least twenty (20) days before the date of the requested visit to the Competent Security Authority of the host Party. 4. The Parties shall inform each other in writing of the Authorities to be responsible for the procedure, control and supervision of the requests for visits. 5. In urgent cases, the request can be transmitted by electronic means at least five (5) days before the date of the requested visit. 6. Requests for visits, including those for recurring visits to a specified establishment, facility or organization in connection with a specific classified project or contract, may be made for a period not exceeding twelve (12) months. When it is expected that a particular visit will not be completed within the approved period or that an extension of the period for recurring visits is required, the visiting Party shall submit a new request for visit through the procedure described in this Article. 7. The Competent Security Authority of the host Party shall inform the security officers of the establishment, facility or organization to be visited of the information regarding those persons in respect of whom approval has been given for a visit. Visit arrangements for persons who have been approved for recurring visits may be 29

30 made directly with the security officers of the establishment, facility or organization concerned. 8. All visitors shall comply with the security regulations of the host Party. Article 10 Classified Contracts 1. A Party intending to sign a Classified Contract with a Contractor of the other Party or to authorize one of its own Contractors to sign a Classified Contract with, or collaborate with, a Contractor of the other Party, shall request the other Party to certify that the proposed Contractor has been granted a Facility Security Clearance to the appropriate level and that the persons involved in the Classified Contract hold the relevant Personal Security Clearance. 2. The Competent Security Authorities of the Parties shall inform each other of any changes in Personal and Facility Security Clearances, particularly in the cases of their withdrawal or downgrading. 3. Each Classified Contract signed under the provisions of this Agreement shall include a security annex containing: (a) classification guide and a list of Classified Information; (b) procedures for communicating any changes in the levels of Classified Information; (c) communication channels and means for electronic transmission; (d) transportation procedures; and (e) relevant authorities responsible for the co-ordination of the security envisaged in the Classified Contract. 4. When the Contract and its security annex expire, unless otherwise specified, the Originating Party may request the return of the information as it considers appropriate, unless the information is considered necessary for the handling and maintenance of the material produced by the Receiving Party after the aforementioned security annex expires. Article 11 Breaches of Security In the event that Classified Information is lost or possibly disclosed to unauthorized persons, the Receiving Party shall immediately inform the Originating Party and shall carry out an investigation into the loss or unauthorized disclosure. The Originating Party shall, if required, co-operate in such investigation. The Originating Party shall 30
