TEACH ENGLISH IN KOREA The University of Wisconsin-Madison ESL Program and the Gyeonggi-do Provincial Office of Education have had a partnership for the past several years to send recent graduates to teach in Korean public schools elementary, middle school or high school. WHAT: Team-teach with a Korean co-teacher in an elementary, middle or high school in the Gyeonggi province of Korea. Your role is to make English come alive. WHEN: The usual starting date is the end of August. Contracts are for one year, renewable. The contract is with the Gyeonggi-do Provincial Office of Education, a Korean government organization. WHO: Those who hold a Bachelor s degree in any field, though preference is given to English or Education majors. Teaching experience and knowledge of Korean are not necessary. WHERE: In a city or small town in Gyeonggi province, the area surrounding but not including Seoul. WHY: Experience a chance to explore another culture, to share your own culture and language, to travel, and to broaden your own knowledge. SOME DETAILS: Round trip transportation paid by you and reimbursed, health insurance stipend, and furnished housing are provided. The salary is approximately $20,000 per year with no Korean or US taxes. PREPARATION; Do some on-line exploration of the field of English as a Second/Foreign language. We will provide you with a handbook which includes lesson ideas as well as tips on living in Korea and working in a public school. CONTACT: Application forms can be emailed to you. Resume - 3 copies Two recommendation letters Medical self-assessment form Criminal record check and apostille Two copies of picture page of passport Interview in person 1. Submit your application and resume, three copies each. Glue a passport photo on the application. Other types of photos are not acceptable. 2. You will need two recommendation letters, one of which should attest to your good character. They may be emailed to me at arfa@wisc.edu. 3. You need an interview in person. This should be enough to determine whether or not this program is right for you. After receiving these items, we can let you know if you have been accepted to go to Korea. 4. Fill out the medical self-assessment form. A medical exam in the US is not needed. You will be asked to get one in Korea after you arrive and pay for it as well. (Note: As of Feb 2011 no form was sent. If one is later required, it will be sent to you. It is quick and easy to fill out.) 5. The criminal record check is vital. Details on each step follow. IF YOU ARE SERIOUSLY CONTEMPLATING TEACHING IN KOREA, START THIS STEP IMMEDIATELY. IT TAKES 8-12 WEEKS TO COMPLETE. You have to do the following: a. get your fingerprints taken b. complete an FBI Criminal Check application c. send the fingerprint card, the application and payment to the FBI. d. when the no record data returns, take the paper to be apostillized. First: Fingerprints FINGERPRINTING SERVICES http://www.cityofmadison.com/police/records/fingerprinting.cfm Fingerprinting services are available through the Madison Police Department, Madison Police Records Section Hours of service: Monday, Wednesday, Thursday, and Friday from 8:00 am to 3:30 pm. Location: 211 S Carroll St, Room GR-10 Madison, WI 53703 The cost is $10.00 per fingerprint card. You must present a valid government issued picture ID. You may call 266-4906 for more information. Second: FBI Criminal Check application http://www.fbi.gov/about-us/cjis/background-checks/background_checks Who May Request a Copy of a Record (or Proof That a Record Does Not Exist) Only you can request a copy of your own Identification Record. You will be requesting this in order to satisfy a requirement to live and work in Korea. How to Request a Copy of Your Record Step 1: Complete the Applicant Information Form (pdf). (Access this from here with Control + click) If the request is for a couple, family, etc., all persons must sign the form.

Include your complete mailing address. Provide your telephone number and/or e-mail address. Step 2: Obtain a set of your fingerprints. Provide the original fingerprint card. Previously processed cards or copies will not be accepted. Your name and date of birth must be provided on the card. Fingerprints should be placed on a standard fingerprint form (FD-258) commonly used for applicant or law enforcement purposes. Step 3: Submit payment. Option 1: Obtain a money order or cashiers check for $18 U.S. dollars made payable to the Treasury of the United States. Please be sure to sign where required. Option 2: Pay by credit card using the Credit Card Payment Form (pdf). Don t forget to include the expiration date of the credit card that you are using. Important note: Cash, personal checks, or business checks WILL NOT be accepted.. If the request is for a couple, family, etc., include $18 for each person. Step 4: Review the FBI Identification Record Request Checklist (pdf) to ensure that you have included all the information we require to process your request. Step 5: Mail the required items listed above applicant information form, fingerprint card, and payment to the following address: FBI CJIS Division Record Request 1000 Custer Hollow Road Clarksburg, WV 26306 What Happens Next If we find no record, you will receive a no record response. If you do have a criminal history record on file, you will receive your Identification Record, or rap sheet. Note: Although the FBI employs the most efficient methods for processing these requests, processing times may take up to 12 weeks depending on the volume of requests received. THE FINAL STEP IN YOUR CRIMINAL CHECK Then you need the criminal check apostillized. This can be done by the Office of the Secretary of State of Wisconsin. This is at 30 W. Mifflin, 10 th floor. A form is on line at http://www.sos.state.wi.us/apos_process_policy.htm.

6. Submit two copies of the photo page of your passport. Be sure that your passport will not expire earlier than September 2011 STEP TWO To be done immediately AFTER you graduate STEP THREE Sealed and stamped official copy of transcript Letter from Registrar (ESL gets this from the Registrar at the UW) certifying your graduation Three copies of the contract, signed on each page Two copies of the security deposit agreement This will take place in June or early July. Work visa application with photo glued on Copy of picture page of passport $45.00 cashier's check or money order made out to the Korean Consulate Passport. You will have to send the actual passport for the visa to be placed inside. You are responsible for turning in your materials. Incomplete application packets cannot be processed. Once you have signed your contract and it has been approved in Korea, you have made a commitment. Therefore be VERY SURE. It causes many problems if you back out after you have been assigned to a school.

Criminal Record Certificate Please note that possession of any criminal record will immediately disqualify you from gaining employment in GEPIK. - Must be Apostillized* ( i.e. have an Apostille number and the stamp)** *(Canada does NOT apply Canadians must get the Consul s notarization seal from the nearest Korean Embassy/Consulate) - A nationwide criminal background check from your own country's government which covers the whole country's information is required. **Apostillized nationwide criminal background checks are required for both overseas applicants and applicants already living in Korea.

7. Self Health Assessment Report Upon successful acceptance into GEPIK, a formal medical examination must be completed in Korea at an approved hospital/public health clinic. The original report must be submitted at the Immigration Office as part of your Alien Registration Card. Please note that a positive result for illegal drug use, alcoholism, or communicable diseases will result in the immediate cancellation of your employment at GEPIK and E2 visa. 8. THREE(3) Copies of the EMPLOYMENT CONTRACT (Attachment 2) Please put your signature on EACH page. No other details need be filled in. 9.TWO(2)Copies of Agreement Letter for Security Deposit (Attachment 3) Please Note: Ensure you have obtained all the documents as specified BEFORE couriering. The pay category set forth at the beginning of this contract will be contingent upon provision of all the necessary documents proving the qualifications and experience required by the Employer to be eligible for said pay category. 제3조(임무) 피고용자의 임무는 다음과 같다. 1. 정규 수업의 경우 한국인교사와 협력수업을 실시하고, 방과 후 또는 영어캠프의 경우 수업을 주도적으로 실시할 수 있다. 2. 영어수업을 설계하고 교수학습자료를 제작한다. 3. 방학 중 학교가 실시하는 영어캠프, 영어교육 관련 특별활동, 교사 연수 등을 지도한다. 4. 학교장이 필요하다고 인정하는 기타 영어교육 관련 업무를 지원한다. 5. 교사 또는 학부모들을 위한 영어회화를 지도한다. 6. 교육청이나 고용자인 학교장이 실시하는 원어민보조교사 연수에 참여한다. 7. 원어민보조교사로서 고용 및 거주에 요구되는 비자서류, 신체/건강검진, 거주자증명서 비용은 일체 피고 용자가 부담한다. Article 3(Duties) The Employee shall perform the following duties: 1. To co-teach with Korean teacher(s) in regular classes and to conduct/lead extra-curricular activities, after school programs, and/or school camps. 2. To prepare lesson plans and teaching materials. 3. To be involved in English day camps, extra-curricular classes, and teacher training during school vacations. 4. To be involved in other educational duties relevant to English education as requested by the Employer. 5. To conduct English conversational class(es) for Korean teachers and/or students parents as requested by the Employer. 6. To participate in GEPIK teachers' workshop(s) conducted by the Employer or GPOE (Gyeonggi Provincial Office of Education). 7. To be responsible for any expenses regarding Visa documents, medical examination, and residency forms for the purpose of residency and employment in Korea. 제4조(지휘감독) 1. 피고용자는 고용자인 학교장의 지휘감독을 받아 제 3 조에서 정한 임무를 행한다. 2. 고용관계의 설정은 다음과 같다. 이 고용계약서에 서명을 통해 채용방법에 관계없이 학교장이 고용자이며 원어민보조교사가 피고용인으로 하 는 고용관계가 성립된다. 피고용인의 근무상황 전반에 관한 지휘감독을 수행한다. Article 4(Supervision) 1. The Employee shall perform the duties specified in the foregoing Article 3 directed and supervised by the Employer. 2. Employment relationship is as follows: Regardless of the method of employment/recruitment, the principal of the appointed school shall take on the role of the Employer, and the Employee shall carry out the duties set forth in the foregoing Article 3. 제5조(고용기간) 1. 고용기간은 1년 (365일)이다. 2. 피고용자가 이유를 불문하고 최초 작성한 계약서상에 명시된 근무 시작일에 근무를 개시할 수 없는 경우,

새로운 1년 고용기간이 명시된 계약서를 한국 입국 후 첫 근무일에 재 작성한다. 계약서는 근무 시작일부터 효력을 발생하며, 고용기간은 근무 시작일로부터 1년간이다. 고용자와 피고용자간에 재계약에 따른 별도의 합의가 없으면, 본 계약은 기간만료일에 자동 종료된다. Article 5 (Term of Employment) 1. The term of employment is for one (1) year (365 days). 2. If the Employee, for whatever reason, is unable to begin work on the date specified herein, the contract shall be rewritten on their first day of work to indicate a full 365 days of employment. The contract will only take effect on the day the Employee is able to begin work and the term of employment shall be a one (1) year period beginning from that day forth. Unless separately agreed otherwise by the Employer and the Employee, this Contract shall automatically terminate at the end of the contract period set forth herein. 제6조(근무지) 1. 피고용자는 경기도내 초, 중, 고등학교에서 근무하는 것을 원칙으로 한다. 2. 고용자는 학교 방학기간 동안 피고용자의 근무지를 교육청, 경기도교육청 산하 연수기관 및 교육기관에서 근무하도록 지시할 수 있다. 이 때, 주당 수업시수가 20시간 이내일 경우에는 피고용자가 추가의 보수를 요 구할 수 없다. Article 6(Work Place) 1. The Employee shall work at a(n)elementary, middle, or high school in the Gyeonggi Province. 2. The Employer shall designate the Employee to work at the Office of Education, training centers or other educational institutes affiliated with GPOE during the school vacation period. In this case, the Employee shall not claim for any additional pay if the hours of work fall under the regular work hours(8 hours per day) and teaching hours(20 hours during vacation) as stated in Article 7. 제7조(근무시간) 1. 피고용자는 점심시간을 포함한 일일 8시간, 주 5일을 근무하며, 토요일과 일요일 및 대한민국 공휴일에는 근무하지 않는다. 2. 피고용자의 근무시간은 대한민국 공무원의 출퇴근 시간을 준용하되, 학교장이 정하는 바에 의해 조정할 수 있다. 3. 피고용자의 정규 수업 시간 수는 주당 22시간이다. 학교장은 피고용자에게 근무시간 내 또는 외의 6시간 까지의 초과수업을 요구할 수 있으며, 주당 6시간 이상을 요구할 경우 피고용자의 동의를 얻어야 한다. 4. 피고용자의 정규 수업 시간 수가 주당 22시간에 미달하는 경우, 학교장은 피고용자에게 부족시수에 대하 여 일반교과수업을 지원하도록 할 수 있다. 5. 고용자는 피고용자에게 초과수업수당을 지급해야 한다. 피고용자는 22시간을 초과할 경우 피고용자는 시 간당 20,000원의 수당을 받을 수 있다. 피고용자는 초과수업시간을 기여휴가로 사용할 수 있으며, 1시간의 수업은 휴가 1시간으로 계산되며, 8시간의 초과수업은 평일 근무 하루로 계산된다. 6. 방학 중에는 고용자가 피고용자에게 추가수당을 지급하지 않고 주당 20시간까지 보충수업이나 영어캠프 활동에 참여하도록 요구할 수 있다. 7. 고용자는 피고용자에게 위의 근무일 또는 근무시간외 수업 이외의 근무를 피고용자의 동의하에 지시할 수 있다. 이 경우에는 시간외 수당 (시간 당 7,000원)을 지급한다. Article 7(Work Hours) 1. The Employee shall work eight (8) hours per day including lunch hour for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays, Sundays and Korean national holidays. 2. The work hours of the Employee shall follow the normal work schedule of civil servants of the Korean Government; however, such work hours may be adjusted by the school principal as he/she deems appropriate. 3. The Employee s teaching hours are twenty-two (22) hours per week. The Employee shall/may be asked to teach an extra six (6) hours within and/or out of the regular working hours. Extra teaching should not exceed six

(6) hours per week without the Employee's consent. 4. If the Employee does not fulfill his/her teaching quota of twenty (22) hours per week, the Employer may ask the Employee to teach classes in other subject areas, outside of English, for the remaining hours. 5. For the extra teaching hours aside from the normal twenty (22) hours per week, the Employee shall be offered with supplementary class instruction pay at the rate of 20,000 KRW per hour or use it as contribution holiday in which eight (8) hours of teaching will be considered as one(1) day. 6. During school vacations, the Employee shall participate in special classes or English day camps up to twenty (20) hours per week. 7. Upon mutual agreement, the Employer may require the Employee to perform duties overtime other than teaching classes in addition to normal work days and work hours. In this case, supplementary overtime pay will be provided (7,000 KRW per hour). 제8조(보수) 1. 원어민의 고용등급과 관련하여 S등급(250만원), 1+등급(240만원), 1등급(230만원), 2+등급(220만원) 2등급 (210만원), 3등급(200만원)으로 계약하여 채용한다 2. 대한민국 법에 따라 국민연금 (약 9%의 반은 학교 부담, *미국인과 캐나다인은 계약만료 후 반환) 및 건 강보험(약 5% 의 반은 학교가 납부)원천징수한다. 국제조세조정에 관한 법률시행규칙에 의거하여 이중과세 방지협약 적용대상 국가에 한하여 (캐나다인 제외) 이중과세면제를 신청하는 원어민은 최초 2년 동안 소득세 이중과세 면제를 받을 수 있다. 3. 보수는 매월 17일에 지급한다. 만일 이 날이 근무일이 아닌 경우, 그 전 근무 날에 지급한다. 4. 피고용자의 근무일 이 한 달이 안 될 경우 근무 개시일 또는 종료일에 따라 일할 계산으로 보수를 지급 한다. 5. 피고용자가 사전 허가 없이 무단 결근하였을 경우에는 결근일수만큼 일할 계산하여 보수에서 공제할 수 있다. 6. 피고용자의 1년간 계약이 만료되면, 1년에 대하여 한달(30일)분의 평균임금을 퇴직금으로 지급한다. 7. 피고용자는 본 계약에 규정된 보수 이외는 일체의 다른 보수를 청구할 수 없다. 8. 최상등급인 S 등급 피고용자에 한하여 경기도교육청 소속 학교와 재계약시 고용자는 경기도 교육청의 교 육목적에 부합한 교수 능력과 실적, 공헌을 평가하여 인정될 경우 최고 월 270 만원까지 매년 10만원씩 월 급을 인상할 수 있다. 9. 계약기간 중 학위 및 자격증 취득으로 인하여 해당등급으로 상향적용이 가능한 경우, 서류제출 다음달부 터 등급상향이 적용되며 상향등급은 한 등급으로 제한한다. Article 8(Salary) 1. The pay scale is as follows: Category S (2.5 mill. KRW); category 1+ (2.4 mill. KRW); category 1 (2.3 mill. KRW); category 2+ (2.2 mill. KRW); category 2 (2.1 mill. KRW); category 3 (2 mill. KRW). 2. The national pension contribution (approx. 9% of which the Employer pays for the half, refundable for the US and Canadian citizens at the end of Contract term) and the national health scheme(approx. 5% of which the Employer pays for the half) as required under Korean law shall be withheld each month from the Employee's salary. Employees, with the exception of Canadians, shall be eligible for Korean income tax exemption during the first two years of Korean employment if they provide the following documents to the Employer before the first payment of salary: 1) Residence Certificate issued by the relevant authority of the Employee s resident country. 2) An Application for Tax Exemption on non-resident's Korean source income provided under the Korean Tax Treaty. If the Employee has already worked more than two years in Korea, he/she shall not be eligible for tax exemption.

3. The Employee's salary shall be paid on the seventeenth (17) of each month. If this day falls on a national holiday, Saturday or Sunday, the salary will be paid on the immediately preceding business day. 4. When the Employee has not worked a full month, the salary for that month shall be paid on a pro rata daily basis either from the first day or until the last day of work. 5. If the Employee should be absent from work without a prior approval, his/her salary for that month shall be deducted by the amount calculated on a pro rata daily basis for the number of unauthorized absent days. 6. After the completion of a one-year contract, the Employer shall pay the Employee an extra thirty (30) days' average wage as a severance pay for the Employee's continuous employment of one (1) year. 7. The Employee shall not claim against the Employer any compensation and/or payment other than those provided for in the Contract. 8. Limited to category S employees only, when the contract is renewed within the GEPIK program, he/she may be eligible for a salary raise up to the maximum limit of 2,700,000 KRW by 100,000 KRW per year respectively. The increase is at the discretion of the Employer, neither automatic nor guaranteed, according to the Employee's teaching performance and contributions made toward the achievement of the educational goals of GPOE. 9. If the Employee obtains further degree or certificate during the contract term, he/she will be promoted to the next applicable employment category (with corresponding raise in salary) in the month following once the necessary document has been submitted. However, promotions shall be limited to one pay category increase per contract year(i.e. Category 3 to 2, Category 2 to 2+; not Category 2 to 1). 제9조(항공료 및 사직) 1. 피고용자의 입국항공료는 한국 입국목적이 경기도교육청 영어원어민보조교사 고용계약서를 이행하기 위 한 것인 경우에 한하여 지급한다. 피고용자의입국후고용자가피고용자의거주지역에서한국인천공항까지의 3등 석 항공편의 실제 구입가를 근무 후 한달(30일)내 지급한다. a. 해외거주 채용 시 피고용자 거주지역에서 인천공항까지의 3등석 항공료가 제공된다. 근무 한달(30일) 내 에 편도요금이 정산 지급되고, 계약완료 후 10일 이내에 본국으로 돌아갈 경우에만 편도 항공료를 환급하거 나 항공권을 지급한다. b. E2비자를 한국에서 최단거리의 외국방문을 통해 발급받은 경우, 근무 한달 (30일) 내에 비자취득 외국방 문 왕복 항공료가 지급되고, 계약완료후의 항공료는 본 조 제 1 항 a 에 따라 지급된다. 2. 피고용자가 부득이한 사유로 고용기간 중에 사직할 경우에는 30일전에 사직 일자와 사유를 서면으로 고 용자에게 통보하여야 한다. 피고용자가 30일 전에 사직하고자 하는 일자와 사유를 서면으로 고용자에게 통 보하지 않고 일방적으로 직을 그만둘 경우, 그 사실이 출입국 관리소에 통보되며 추후 피고용자의 한국 입 국 시 불이익을 당할 수 있다. 3. 피고용자가 계약기간 중 사직하는 모든 경우에는 귀국항공료를 피고용자가 부담하며, 피고용자의 E2비자 는 취소된다. 4. 고용계약 개시일로부터 6개월 미만에 본 계약이 조기에 종료되는 경우 피고용자 는 계약 종료 즉시 정산 지급된 입국항공료 100% 및 최초 생활정착금 30만원을 고용자에게 반환한다. 피고 용자가 고용기간 개시일로부터 6개월 이상 근무하는 경우 본 항에 의한 항공료의 상환 의무는 면제되나, 최 초 생활정착금 30만원은 고용자에게 반환한다. Article 9(Airfare and Resignation) 1. The airfare for the Employee's flight to Korea shall be considered as a support for the Employee's entrance into Korea for the purpose of employment as a GEPIK teacher. The Employee shall receive the reimbursement of the airfare by the Employer within a month (30 days) upon working at the school, based on the actual purchasing price of an economy class flight available from the Employee's residence to Incheon International Airport in Korea. a. The Employee from outside of Korea: A one-way economy ticket from the Employee's residence to Incheon International Airport will be reimbursed within a month (30 days) from working at the school. Upon the completion of the Contract, a one-way return trip to the airport of his/her home country will be reimbursed or directly

purchased only when the trip occurs within the first ten (10) days as of completion of employment. b. If the Employee obtains his/her E2 visa by visiting the nearest country from Korea, its round trip airfare is reimbursed by the Employer within a month (30 days) from working at the school. Upon the completion of the Contract, a one-way airfare is provided pursuant to the foregoing 1-a. 2. If the Employee decides to resign during the term of employment, he/she must give the Employer a thirty (30) day prior written notice of resignation stating the date of and reason for resignation. An unannounced resignation of the Employee, without a thirty (30) day prior written notice of resignation to the Employer, shall be reported to the Korean Immigration Service and shall affect the Employee's entrance to the Republic of Korea in the future. 3. In all cases of the Employee's resignation without fulfilling the full year term, the airfare for his/her return trip shall be borne by the Employee, and his/her E2 visa shall be cancelled. 4. In case of the termination of the Contract within the first six (6) months, the Employee shall immediately pay back 100% of the one-way airfare into Korea and the settlement allowance of 300,000 KRW to the Employer. If the Employee worked for six (6) months or more during the term of employment, the Employee's obligation to pay back the airfare shall be waived by the Employer. However, the settlement allowance of 300,000 KRW shall be paid back to the Employer. 제10조(계약만료) 1. 제 5조에서 정한 고용기간은 피고용자와 고용자간의 합의에 의하여 1년(12개월)단위로 재계약 한다. 2. 학교장과 피고용자는 계약만료 2개월(60일) 전에 재계약 여부를 서면으로 알린 3. 경기도내에서 학교를 바꾸는 경우 재계약으로 간주되지 않으며, 재계약시 주어지는 재계약 휴가와 왕복항 공권은 주어지지 않는다. 4. 본 조 제1항의 규정에 의해 같은 학교에서 재계약을 체결하는 피고용자에게는 주말 및 공휴일 포함한 두 주간(14일)의 재계약휴가를 제공하는데, 이는 계약기간 중 제공되는 유급휴가 외에 추가로 제공되는 혜택이 다. 재계약휴가는 재계약 고용 개시 후 6개월 이내로 휴가를 사용하여야 하며, 학기 중 수업에 영향을 주지 않는 방학기간을 사용해야 한다. 5. 피고용자의 재계약 왕복항공료는 피고용자의 입국 후 고용자가 피고용자의 거주지에서 가장 가까운 공항 으로부터 한국 인천공항까지를 기준으로 한 3등석 항공요금을 귀국 후 2 주 내에 환급한다. 6. 재계약 시, 피고용자가 고국을 방문하지 않을 경우에는 본국 거주지역까지의 대한항공 국제선 3등석 왕 복항공요금을 최고 200만원을 넘지 않는 범위 내에서 재계약 시작일 이후 2 주 내에 지급하며, 휴가제공은 본 조 4항을 따른다. 7. 피고용자가 고용기간의 근무를 마치고 재계약할 의사가 없이 열흘(10일) 이내에 한국을 떠날 경우 귀국항 공료를 환급하거나/항공권을 지급한다. 8. 6개월 미만 재계약 해지 시 재계약휴가는 무급으로 처리하고, 재계약 왕복항공료는 고용자에게 반환한다. 피고용자가 재계약 해지일로부터 열흘(10일) 이내에 한국을 떠날 경우 귀국항공료를 환급하거나/항공권을 지 급한다.. Article 10(Completion of the Contract) 1. The Term of Employment stated in Article 5 may be renewed by a mutual written agreement between the Employer and the Employee. Each renewed employment term is for one (1) year only. 2. The written notification of renewal or completion of employment shall be provided two months (60 days) prior to the expiration of the Contract. 3. Upon completion of the first year term, if the Employee changes school and region in Gyeonggi Province, this is not considered as a renewal, and therefore the renewal leave and round-trip flight shall not be given. 4. In the case of renewal of this contract pursuant to the foregoing 1, the Employee shall be given a fourteen (14) day (weekend and national holidays inclusive) renewal leave which is additional, beyond the yearly paid leave. Renewal leave must be taken during the vacation periods not conflicting with school schedules within six (6)

months from the first date of the renewal contract. 5. In the event a renewing Employee travels to his/her home country, the Employee shall be reimbursed for his/her round-trip airfare based on economy class airfare of the flight available from Incheon to the airport nearest to the Employee's residence within two (2) weeks upon return to Korea. 6. In the event a renewing Employee does not travel to his/her home country, the Employee shall be given the amount of money equivalent to the round-trip airfare to the airport nearest to the Employee's residence based on the economy class rate of Korean Airline up to a maximum of 2.0 million KRW within two (2) weeks from the first date of the renewal contract. Renewal leave is used in the manner pursuant to the foregoing 4. 7. If the Employee completes the term of employment without the intention to renew and leaves Korea within ten (10) days from the contract completion date, the Employer shall provide the airfare for the Employee's one-way return flight to the Employee's home country either in the form of reimbursement or direct purchase. If the Employee does not leave Korea within ten (10) days from the contract date then the airfare for the Employee's one-way return flight to the Employee's home country will not be provided. 8. Upon termination of a renewal contract within the first six (6) months, the fourteen (14) day renewal leave received when renewing will be considered as unpaid leave and the round-trip airfare shall be paid back to the Employer. If the Employee leaves Korea within ten (10) days from the termination date of the renewal contract, the Employer shall provide the airfare for the Employee's one-way return flight to the Employee's home country either in the form of reimbursement or direct purchase. 제11조(계약 해지) 1. 고용자는 다음과 같은 경우에 본 계약을 해지할 수 있다. a. 피고용자가 대한민국법을 위반하는 경우 b. 피고용자가 계약사항을 이행하지 아니하거나, 성실하게 임무를 수행하지 않아 3회 이상 서면 경고를 받 은 경우 (출국 시 해지통보 한 후 30일간의 기간을 둠) c. 피고용자가 특별한 이유 없이 근무일 기준 5일 이상 연속하여 근무를 하지 않는 경우 d. 피고용자가 제출한 지원서의 내용이 사실이 아니거나 거짓이 있는 경우 e. 피고용자가 신체적, 정신적 질환 또는 만성질환이(당뇨, 고혈압, 간질환, 결핵, 뇌질환, 약물중독, 알콜중독 등) 있어 계속 근무하기가 어렵다고 판단되는 경우 (피고용자는 고용자가 건강진단을 요구하면 즉시 이에 응하여야 한다.) f. 본 계약 제15조 3항에서 정한 피고용자의 병가 기간(유급 및 무급 포함)이 고용기간 동안 총30일을 초과 하는 경우 g. 피고용자가 고용자가 지정한 근무지 이외의 다른 기관에서 영업 행위(시간제, 과외, 온라인 수업, 지속적 인 영리강의(대학 등) 포함)를 한 경우 h. 피고용자가 E-2 비자 등 적법한 비자를 소지하지 않고 근무한 경우 2. 본 조 제1항 각호의 사유로 인하여 6개월 이내에 본 계약이 해지되는 경우 피6고용자는 제9조 제4항에 따라 대여금(항공료)을 즉시 상환하여야 하고 피고용자의 비자는 취소된다. 계속 근무하여 6개월이 경과한 경우에는 피고용자의 비자는 취소되며 제9조 제4항의 항공료의 상환 의무는 면제되나, 최초 생활정착금 30 만원은 고용자에게 반환한다. 3. 피고용자가 금고형이나 그 이상의 중형을 선고받을 경우, 본 계약은 자동적으로 해지되며, 고용자는 금전 상 어떠한 보상도 하지 않는다. Article 11(Termination of the Contract) 1. The Employer may terminate or cancel this Contract upon occurrence of any one of the following events: a. If the Employee violates the laws of the Republic of Korea. b. If the Employee fails to perform or unsatisfactorily performs any of the duties stipulated in this Contract and has received three or more written warnings from the Employer (on receiving the termination notice, a 30-day period for departure is given).

c. If the Employee continuously fails to perform his/her duties for more than five (5) working days without any excuse. d. If any of the information provided in the Employee's application is found to be intentionally false or inaccurate. e. If it is determined that the Employee is prevented from or incapable of performing his/her duties for a medical reason, whether it is a physical or psychological ailment in nature, including chronic ailments such as diabetes mellitus, high blood pressure, chronic liver disease, tuberculosis, neurologic disorder, substance or alcohol addiction, etc. (if requested by the Employer, the Employee must be immediately available for a medical examination). f. If the sick leave (both paid and unpaid) used by the Employee pursuant to Article 15-3 hereof exceeds thirty (30) calendar days. g. If the Employee engages in any other employment (including any part-time, private or self-employment, online instruction or continuous profitable work at institutes including universities). h. If the Employee works in Korea without holding the required valid visa such as E-2 visa, etc. 2. In the event of the termination of the Contract within the first six (6) months pursuant to any of the provisions set forth in the foregoing 1, the Employee shall immediately refund the settlement allowance and the airfare to the Employer according to Article 9-4. Also, the Employee's visa will subsequently be cancelled. In the event of termination after six (6) months of continuous employment or longer, the Employee is not required to refund the airfare. However, the settlement allowance of 300,000 KRW shall be paid back to the Employer. 3. If the Employee is sentenced to a term of imprisonment (or any other more severe penalty), the Employee shall automatically be dismissed and the Employer will not provide any financial compensation. 제12조(주거) 1. 고용자는 피고용자가 도보로 출퇴근이 가능하도록 학교에서 가까운 지역으로 주거를 제공한다. 장거리 출 퇴근이 불가피한 경우 벽지 농어촌 지역에 한하여 고용자는 피고용자에게 출퇴근 보조비용 (대한민국 일반 대중교통비에 의거)을 제공 할 수 있다. 피고용자의 희망대로 교통시설의 이용에 가까운 주거를 확보하도록 최대한 노력해야 한다. 2. 주거지 혹은 주거비의 지원 여부 및 주거 형태는 고용자가 선택하며, 일단 선택한 이후에는 고용기간 동 안 이를 변경할 수 없다. 피고용자의 개인적인 사정으로 인한 주거 변경 시 발생하는 모든 경비는 피고용자 가 부담한다. 3. 주거 형태는 임대주택, 기숙사, 또는 아파트를 포함하나 이에 한정되지 않는다. 독신자에게는 학교 기숙 사나 외부에 있는 1인용 방을 제공하고, 가족을 동반하는 강사에게는 2개의 침실이 있는 주거를 제공한다. 주거 사용에 따른 제세공과금 및 개인적인 사정 (결혼 등)으로 인한 주거 변경 시 발생하는 모든 경비는 피 고용자의 부담으로 한다. 4. 고용자는 피고용자의 주거를 선정될 때까지 임시주거를 제공할 수 있으며, 고용 기간 동안 주거를 제공하지 못하거나 자기 스스로 구하기로 결정한 경우에는 피고용자에게 매월 400,000원 의 주거비를 지원한다. 5. 고용자가 주거를 제공하는 경우 <부록1>에 명시된 가전제품 및 가구를 제공할 수 있으며, 그 외의 물품 을 요구할 수 없다. 제공된 물품에 대한 관리 및 수리 일체에 대하여는 피고용자가 책임을 진다. 6. 최초 계약 시 고용자는 고용계약 첫 해 1회에 한하여 생활정착금으로 300,000원을 학교근무 한 달(30일) 내에 피고용자에게 제공한다. 피고용자는 상기 항 이외에 생활에 필요한 물품을 구입하는 데 사용하여야 한 다. 7. 고용자가 제공한 숙소를 사용할 경우 피고용자는 고용 기간 만료일 익일까지 퇴실한다. 퇴실할 시 처음 입주 시와 같은 상태로 숙소를 보존하여야 하며, 피고용자가 거주한 기간 중에 발생한 건물이나 가전제품 및 가구에 대한 손상에 대하여 피고용자는 책임을 진다. 8. 고용주는 결혼한 부부가 동반 지원한 경우에 한하여 동반 주거를 제공할 수 있으며, 피고용자는 부부의 성(last name)이 다를 경우 결혼증명서 등을 제출하여 혼인 상태를 입증하여야 한다.

Article 12(Housing) 1. The Employer shall provide the Employee with housing. All efforts will be made to provide an accommodation within walking distance to the school or near transport facilities. Limited to rural areas, when long distance travel is necessary, the Employer shall grant the Employee a commute subsidy based on the Korean public transportation rate. 2. The Employer shall decide on the type of housing and whether to provide the Employee with housing or a rent subsidy. Once decided, the Employer's decision shall not be subsequently changed during the term of employment. The Employee shall borne any and all costs incurred as a result of changing housing due to personal reasons during the term of employment. 3. Housing selected by the Employer may be, including but not limited to, a leased house, dormitory, or an apartment. A single teacher shall be provided with a one-room apartment on or off campus, and a married teacher with dependents shall be provided with a residence with two bedrooms. Any and all fees, charges, costs, taxes, expenses, etc. additional to monthly renting fees and/or key money incurred in using the housing shall be borne by the Employee (e,g. maintenance fee, monthly electrical, water, and gas fees). In case of moving, any cost incurred shall be borne by the Employee if the move is due to the Employee's personal matter (e.g. marriage). 4. The Employer may provide temporary housing until the appropriate housing for the Employee becomes available. If the Employer is not able to provide housing for the Employee or if the Employee decides to find housing on their own, the Employer shall provide the Employee with 400,000 KRW per month, as a rent subsidy, in lieu of the housing set forth in the foregoing 1. 5. If the Employer provides housing to the Employee, the Employer may provide appliances and furniture (refer to Appendix 1). The Employee shall not request or demand any other appliances or furniture than those provided by the Employer. The Employee shall take the responsibility for the maintenance and repair for the appliances and furniture provided by the Employer. 6. The Employer shall provide the Employee, for the first GEPIK contract assignment term only, 300,000 KRW as settlement allowance within the first month (30 calendar days) of working at the school. The Employee shall spend the money to buy commodities other than those set forth under Article 12-5. 7. If the Employee uses the housing provided by the Employer, upon completion of the contract and departure, the Employee shall leave the housing in the same condition as when it was first occupied and the Employee shall be liable for any damage to the building and appliances that occurred during the period occupied by the Employee. 8. The Employer shall provide couples housing only to married couples jointly employed by the Employer. If the couple holds different last names, they must prove their marital status with a marriage certificate or other relevant documentation. 제13조 (기타 혜택) 1. 고용자는 피고용자에게 대한민국 건강보험법에서 정한 건강보험료의 50%를 제공하며 (건강보험법에는 건강보험료의 50%는 피고용자가 부담하도록 규정하고 있다), 피고용자1인을 원칙으로 하되, 가족 동반 시 가족건강보험료를 포함하여 지원한다. 2. 지정된 농어촌, 벽지학교*에 근무하는 피고용자에게는 매월 100,000원씩의 수당이 지급되고 학교장 재량 하에 5일의 휴가기간이 따로 주어질 수 있다(*한국인 교사에게 가산점이 부여되는 학교). Article 13(Other Benefits) 1. The Employer shall provide the Employee with medical insurance pursuant to The National Health Insurance Act of Korea(The National Health Insurance Act states all government employees will be liable for 50% of costs). If the Employee has his/her dependents living with him/her in Korea, the Employer shall also provide health

insurance for them. 2. The Employee who is working at a school in a designated rural area shall be entitled to a paid allowance of 100,000 KRW every month. Also, at the discretion of the Employer, an additional five (5) working days' paid leave can be given during the contract term (designations for rural and non-rural areas are determined individually by the undersigned Office of Education). 제14조 (유급휴가) 1. 고용자는 피고용자에게 고용기간 동안 학기 중이 아닌 기간에 20일의 유급휴가를 제공하며, 15일전에 소 속 기관장에게 휴가를 신청하여 승인을 받아야 한다. 피고용자는 20일의 유급휴가를 학기 중이 아닌 기간에 나누어 사용해야 한다. 토요일과 일요일은 유급휴가일에 포함시키지 않는다. 피고용자가 계약기간을 만료하 고 재계약한 경우에, 사용하지 않은 유급휴가는 7일까지 새로운 계약에 이월될 수 있다. 이 기간은 새로운 계약에서 우선적으로 사용되어야 하며 그 이후의 계약기간에는 반영되지 않는다. 2. 피고용자 본인의 출산 휴가 시 최초의 60일에 대해서는 유급휴가를 제공한다. 3. 피고용자는 방학 기간이라 할지라도 유급 휴가나 무급 휴가를 사전 승인 받은 경우가 아니라면, 정상적으 로 근무하여야 한다. 4. 지각, 조퇴, 외출 및 반일연가 1회의 경우 누계시간으로 계산하며 8시간을 1일로 공제한다. 8시간 미만은 계산하지 않는다. 5. 6개월 미만 (재)계약 파기 시 기사용 한 유급휴가는 월 할 계산한다. 6. 고용자는 본 조 1항에 명시된 유급휴가와 별도로 학교장 재량으로 학교 재량휴업일이나 개교기념일 등으 로 인한 학기 중 휴무일에 피고용자를 출근시키지 않을 수 있다. Article 14 (Paid Leave) 1. The Employee shall be entitled to a paid leave for a total of twenty (20) working days during the term of the employment. Paid leave shall be taken at any time when school is not in session and be divided, and must be approved by the Employer at least fifteen (15) days in advance. The weekends (Saturdays and Sundays) and the Korean national holidays do not count as vacation days. If the Employee renews the contract, up to seven (7) days of unused yearly paid leave may be rolled over to the new contract period. This carried over paid leave may be used in the new contract period, but it may not be rolled over into any subsequent contract period. 2. In the case of maternity leave, the first sixty (60) calendar days shall be considered as paid leave. 3. The Employee shall note the difference between school vacation and paid vacation days: the Employee is expected to fulfill normal working duties during the school vacation period unless the Employee has received prior approval for paid vacation or unpaid leave during the school vacation period. 4. Regardless of the number of days over which the paid leave falls, eight (8) accumulated hours of paid leave shall be counted as one (1) day. This includes tardiness, early leave, and other absences during the work day and/or half-days of paid leave. A total of less than eight (8) hours will not be counted. 5. Upon termination of the contract within the first six (6) months, the used paid leave will be calculated based on a pro-rata monthly basis. 6. During the school semester, the Employer may allow the Employee to not come to work on the day(s) when the school is closed for in-semester school holiday(s), school anniversary day(s), etc., and these days will not be considered part of the paid leave set forth in the foregoing clause 1. 제15조(병가) 1. 피고용자는 고용기간 중 출근할 수 없는 정도의 질환이 있을 때 근무 시간 시작 후 1시간 이내에 소속기 관장의 승인을 받아 유급병가를 받을 수 있다. 2. 유급병가기간이 근무일 기준 연속 3일 이상일 경우나 고용자의 요구가 있을 경우에는 진단서를 소속기관 장에게 제출하여야 한다. 3. 피고용자의 유급병가 기간은 고용기간 동안 총 11일이며, 11일을 초과하는 경우에는 무급으로 한다. 4. 피고용자의 병가 일수 및 사유는 인사기록 카드에 기록되며 고용자는 피고용자의 복무 평가 및 재계약시

근거 자료로 활용한다. Article 15(Sick Leave) 1. The Employee shall be entitled to a paid sick leave in the case of any illness or injury which prevents the Employee from performing the duties herein only with the expressed consent of the Employer. The Employee shall notify the Employer of any absence due to sickness within one (1) hour of the beginning of the Employee's working hour. 2. A practicing doctor's medical report shall be required for any and all sick leave taken for more than three (3) consecutive days or upon the request of the Employer. 3. The Employee's paid sick leave during the Term of Employment shall not exceed eleven (11) working days. If the Employee requires a sick leave for more than eleven (11) working days, the Employee may take a longer sick leave without pay. 4. The total number of days of sick leave (both paid and unpaid) used by the Employee and the reasons for taking sick leave will be included in the Employee's Personnel Record Card, which shall be utilized by the Employer to evaluate the Employee's conduct and determine the Employee's contract renewal. 제16조(특별휴가) 1. 피고용자는 다음 각 호의 사유가 있을 경우 특별휴가를 받을 수 있다. 특별휴가의 기간은 토요일과 일요 일 대한민국 공휴일을 포함하여 산정된다. a. 피고용자 본인의 결혼 연속7일 b. 피고용자의 부모 또는 배우자 사망 연속7일, 자녀 사망 연속5일 c. 피고용자 본인의 출산 전후를 합하여 90일 d. 자연재해로 인한 휴가 e. 기소로 인한 휴가 f. 배우자 출산시 3일 g. 본 조 제1항 제a호, 제b호, 제c호의 기간 중 최초의 60일 및 제d호는 보수가 지급되나, 제e호는 보수가 지급되지 않는다. Article 16(Special Leave) 1. The Employee may take a special leave for a number of days as set forth below for each of the following events. The duration of the special leave shall include Saturdays, Sundays and national holidays of the Republic of Korea: a. Seven(7) consecutive calendar days for the Employee's marriage. b. Seven (7) consecutive calendar days for the death of the Employee's parents or spouse; five (5) consecutive calendar days for the death of the Employee's child. c. Ninety (90) calendar days for the Employee's maternity leave. d. In case of damage to the Employee's residence in a natural disaster: for the period the Employer deems necessary according to the degree of damage. e. If the Employee is prosecuted for involvement in a criminal offense, the Employer has the authority to put the Employee on a prosecution leave. f. Three (3) calendar days for paternity leave. g. Special leave specified in items 1-a, 1-b, the first sixty (60) days of 1-c, 1-d and 1-f shall be considered as paid leave. However, the item 1-e shall be considered as unpaid leave. 제17조(복무) 1. 피고용자는 임무수행에 관련된 소속기관장의 지시를 성실히 이행하여야 한다. 2. 소속기관장은 따로 정한 지침에 따라 피고용자의 공적 업무 수행 능력을 평가한다. 3. 피고용자는 특별히 정해진 경우를 제외하고 이 계약서의 내용과 조건에 따른 의무를 성실히 이행해야 한

다. 4. 피고용자는 교사의 품위를 손상시키는 행동을 해서는 안되며, 한국인교사에 적용되는 복무규정을 준수해 야 한다. 5. 피고용자는 고용자가 지정한 근무지 이외의 다른 기관에서 영업 행위(시간제, 과외, 온라인 수업, 지속적 인 영리강의(대학 등) 포함)를 할 수 없다. 6. 피고용자는 업무기간 중 지득한 비밀 등 중요 자료를 누설하거나 사적으로 이용하여서는 아니 된다. Article 17 (Office Regulations and Restrictions) 1. The Employee shall faithfully fulfill his/her Employer's requests on his/her duties as defined in the Contract. 2. The Employer shall the evaluate Employee's performance of official duties. 3. The Employee shall make every reasonable effort to fulfill their prescribed duties and responsibilities according to the terms and conditions of this Contract. 4. The Employee shall make every reasonable effort to uphold the positive reputation of the Korean teaching profession by conforming to the code of conduct as expected of teachers by Korean society. 5. The Employee shall not engage in any other employment (including any part-time, private or self-employment, online instruction or continuous profitable work at institutes including universities). 6. The Employee must not disclose any confidential information about their co-workers, school or program that they have acquired during their term of employment. 제18조 (연수 이수 및 교원능력개발평가) 1. 피고용자는 경기도교육청 또는 지역교육청에서 주관하는 사전연수 및 각종 직무연수를 이수하여야 한다. 2. 피고용자는 고용자가 요구할 시 연수 프로그램에 참가하여야 한다. 3. 피고용자는 고용자가 실시하는 교원능력개발평가에 성실히 임한다. Article 18 (Completion of Mandatory Orientation, and Evaluation of Teaching Performance and Conduct) 1. The Employee shall complete all training(s) deemed necessary by GPOE and/or the undersigned district Office of Education. 2. The Employee shall participate in any training(s) upon request of the Employer. 3. The Employee shall sincerely participate in the Evaluation of Teaching Performance and Conduct required by the Employer. 제19조(손해배상) 1. 본 계약의 이행과정에서 피고용자의 주의태만, 과실, 위법행위 또는 이와 관련하여 발생될 수 있는 손해 배상을 피고용자에게 요구하기 위하여 고용자는 피고용자의 동의를 받아 일정금액을 담보한다. 최초급료부 터 매월 300,000원씩 3개월간 총 900,000원을 매월 급료지급일의 익일인 매월 18일까지 피고용자가 행정실 에 지급한다. 이 900,000만원의 공제는 피고용자가 주택을 구한 경우나, 결혼한 부부가 경기도교육청 산하 학교에 모두 고용된 경우에도 해당된다. 2. 피고용자의 계약만료까지 고용자는 대여한 시설물 이용과 그에 관련된 재정사항 등에 대한 사전점검을 실시하여 발생된 손해가 있을 경우 피고용자에게 서면 확인하고 담보한 금액으로 배상 조치하고, 부족할 경 우에는 추가로 피고용자에게 배상을 요구하여야 한다. 피고용자가 시설물 이용에 대한 주의 성실의 의무를 다하여 손해가 없을 경우에는 담보한 금액을 계약 만료 후 한 달 이내 반환하여야 한다. Article 19 (Security Deposit) 1. The Employee shall be responsible for any liability or damages arising from or in relation to any negligent, faulty, or illegal activity during the term of employment under this Contract. Therefore, the Employee shall agree in written form to provide 300,000 KRW per month to the school administration office either on or by the eighteenth (18) of every month for the first three (3) months of employment until it amounts to a total of 900,000 KRW. The Employee who has their own housing arrangement and married couples who are both employed by GPOE shall also be required to provide the deposit to his/her respective schools.
