1 정부초청 해외 영어봉사 장학금 계약서 TaLK SCHOLARSHIP CONTRACT I. 장학생 서약서 ( SCHOLAR'S PLEDGE ) 나, 는 정부초청 해외 영어봉사 장학생(TaLK)으로 선정되어 장학금을 받게 되었으므로, 향후 TaLK 장학생으로서 본 프로그램을 수행함에 있어 다음 사항을 지키도록 하겠습니다. I, understand that a TaLK scholarship has been awarded to me and, henceforth, I will abide by the following terms to complete the program as a TaLK scholar: 계약서 내용에 따라 장학생으로서의 임무를 완수하겠습니다. 수업지도를 포함한 장학생으로서의 의무를 지키기 위해 최선을 다하겠습니다. 비윤리적 행위, 적극적 정치 종교 활동 등 한국의 사회질서를 위반하는 행위를 하지 않겠습니다. 학교 배치에 관해서 TaLK Office와 시ㆍ도교육청의 결정에 따르겠습니다. TaLK Office 와 시 도교육청이 정한 조건과 규정을 준수하겠습니다. TaLK 장학생으로서 모범이 되고 성실하게 활동하겠습니다. I will complete the program according to the contract agreements. I will fulfill my obligations as a scholar including class instructions to the best of my ability. I will not engage in any unethical behavior, or inappropriate political and/or religious activity that may violate the norms of Korean culture and society. I will agree to the decision of the TaLK Office/Provincial Office of Education (POE) concerning the school placement. I will abide by all of the terms and regulations set by the TaLK Office/POE. I will set a good example and represent TaLK with integrity. 상기 사항을 위반하거나 지원서류에 허위 기재 사실이 드러날 경우, 장학생 자격 상실, 장학금 지급 중단 등 TaLK Office와 시ㆍ도교육청이 정한 결정에 따르겠습니다. If I am proved to have violated the above-stated terms or to have made any false statements in my application documents, I shall accept the decision of the TaLK Office/POE to disqualify me from the program and to cancel the scholarship. 나는 이 계약서에 서명함으로써, 본 계약서가 정당하고 구속력 있는 합의라는 것에 동의합니다. 또한 계약서의 모든 규정에 동의하며 동 규정을 확실히 준수하겠습니다. 2 Ⅱ. 정부초청 해외 영어봉사장학금 합의서( TaLK SCHOLARSHIP AGREEMENT ) 이 합의서는 대한민국의 정부초청 해외 영어봉사 장학생 프로그램으로 선발된 장학생의 의무와 장학 지급조건에 관한 사항을 규정함을 목적으로 한다. 이 합의서는 2010 년 월 일 교육감과 TaLK 장학생 에 의해 작성되었다. 합의내용은 다음과 같다: This agreement is made for the purpose of setting forth the terms and conditions of scholarship for scholars who participate in the TaLK (Teach and Learn in Korea) Program. This AGREEMENT is made on, 2010 between PROVINCIAL OFFICE OF EDUCATION and, a TaLK SCHOLARSHIP RECIPIENT. It is agreed as follows: 1. TaLK장학생 프로그램에 따른 장학생의 의무 1.1 TaLK장학생은 한국의 농 산 어촌 초등학생에게 영어를 가르치면서 한국의 문화를 배울 수 있는 기회를 갖는다. 1.2 장학생은 정부초청해외영어봉사장학생 사전연수교육을 모두 마쳐야 하며, 수료하지 못한 경우 장 학생 자격이 박탈될 수 있다. 1.3 학기 중에는 배정받은 초등학교에서 방과후학교 영어수업을 활용하여 봉사하여야 한다. 1.4 장학생은 배정된 시 도교육청이 지정하는 기타의 업무를 보조하여 수행하고, 방학 중에는 각종 영어프로그램을 진행하여 영어봉사를 하며, 한국문화를 체험하여 한국을 배워 본 제도의 취지를 살리도록 노력하여야 한다. 1.5 학교장의 요청이 있을 경우, 방과후학교 수업 이외에 교내 각종 영어교육활동 또는 학교와 지역 사회의 특별활동 등을 수행할 수 있다. 1. Duties 1.1 Scholar shall teach English to elementary school students in rural areas of Korea while learning about the Korean culture. 1.2 Scholar shall complete the on-site orientation prior to their first term of teaching. Otherwise, Scholar may be subject to disqualification from further participation in the TaLK program. 1.3 Scholar shall teach English in after-school classes in the elementary school designated by POE during the school year. 1.4 Scholar shall perform other duties as designated by POE including various English programs held during school vacation and participate in the cultural programs arranged by POE. 1.5 Scholar may assist with activities related to English language education and other extracurricular activities within the Work Place and the community upon request made by the Head Person of the Work Place. 2. 협조의무 장학생은 영어수업을 효율적으로 진행하기 위하여 시 도교육청이 지정하는 소속기관장의 관리를 받 는다. 2. Supervision Scholar shall carry out the duties set forth in the foregoing Clause '1' pursuant to and under specific instruction and supervision of the Head Person of the Work Place designated by POE.

3 3. 장학기간 장학기간은 2011년 2월 1일부터 년 월 일까지 ( ) 개월로 한다. 3. Term of Scholarship Th e Term o f Sch olarship sha ll com m ence on Feb ru ary 1, an d en d o n, ( ) m o n ths. m m / dd / yy 4. 봉사활동 기관 4.1 장학생은 교육청이 지정하는 초등학교에서 의무활동을 수행하여야 한다. 4.2 시ㆍ도교육청은 장학생의 활동장소를 복수의 기관으로 지정할 수 있다. 4. Place of duties 4.1 Scholar shall perform his/her duties at an elementary School located in Province. 4.2 POE may designate multiple Work Places for Scholar. 5. 영어봉사활동 시간 5.1 장학생은 농ㆍ어촌 초등학교 방과후 교실을 활용하여 주15시간(초등학교 수업시간 기준) 영어봉 사활동(수업)을 하며, 토요일과 일요일 및 대한민국 공휴일은 봉사활동을 하지 않는다. 5.2 장학생은 위 1 항의 봉사활동을 위해 사전에 성실히 준비하여 학생들에게 역할모델이 될 수 있 도록 노력한다. 5.3 장학생이 영어봉사활동을 위하여 학교에 체류해야 하는 시간은 소속기관장과 상의하여 자율적으 로 정할 수 있으며, 영어봉사 수업지도에 지장이 초래되지 않는 시간대로 정하도록 한다. 5.4 장학생은 소속기관장과 장학생 상호 요구와 동의가 있을 경우, 정규수업을 담당할 수 있으며, 주 15시간 이상의 수업을 할 수도 있다. 단, 봉사활동 시간을 초과할 경우의 처우는 시ㆍ도교육청 내부지침에 따른다. 5. Teaching hours 5.1 Scholar shall teach fifteen (15) hours, according to the time frame for elementary school classes, per week from Monday to Friday and shall not work on Saturdays, Sundays and any national holidays of the Republic of Korea. 5.2 Scholar shall dutifully prepare for the classes set forth as above mentioned in Clause 1 and do his/her best to set an example as a role model to students. 5.3 Scholar's work hours may be arranged based on agreement between the Head of the Work Place and Scholar and must be arranged so that they do not interfere with his/her class instruction. 5.4 Scholar may teach non-after school programs exceeding the compulsory fifteen (15) hours per week, based on demand and agreement between the Head Person of the Work Place and Scholar. For extra hours exceeding fifteen (15) teaching hours, Scholars shall adhere to the policies and regulations set forth by POE for overtime compensation. 6. 장학금 6.1 장학생은 영어를 가르치면서 한국 문화를 안정적으로 체험할 수 있도록 활동보조비와 생활비를 포함하여 장학금으로 매월 한화 150만원을 지급받는다. 6.2 장학금은 매월 25일에 지급한다. 만일 지급일이 대한민국법에 의한 공휴일인 경우에는 전날에 지 급한다. 6.3 장학금은 영어봉사활동시간을 준수하였을 경우 전액이 지급되며, 장학생의 개인적 사정으로 봉사 활동 의무를 수행하지 못할 경우 그 시간에 비례하여 지급하지 아니한다. 6.4 기타 본 조항에 언급되지 아니한 사항은 시ㆍ도교육청 내부지침에 따른다. 6. Scholarship 6.1 Scholar shall receive the total amount of 1.5 million Korean Won (KRW) per month which includes monthly stipends and activity allowances to support teaching duties and learning experiences about the Korean culture. 6.2 The scholarship money shall be disbursed on the 25th of each month. If this day falls on a

4 national holiday, Saturday or Sunday, it will be paid on the immediate preceding business day. 6.3 The full amount of the monthly scholarship fund will be disbursed upon completing the required teaching hours per month, and for any work missed, the scholarship fund for that month shall be disbursed in accordance with the actual teaching hours. 6.4 For matters not explicitly stated in Clause '6', Scholars shall adhere to the policies and regulations set forth by the POE. 7. 항공권 7.1 TaLK Office는 장학생에게 장학생의 거주 지역 인근 국제공항에서 한국 인천공항까지의 최단 거 리를 기준으로 한 3등석 편도 항공권을 제공한다. 장학계약 개시일로부터 1개월 미만에 본 계약 이 조기에 종료되는 경우 장학생은 장학계약 종료 즉시 위 항공권에 상응하는 금액을 TaLK Office에 반환한다. 단, 특별한 사유가 발생하여 TaLK Office가 인정하는 경우에는 그러하지 아니 하다. 7.2 장학생이 장학기간을 완수하고 귀국할 경우, TaLK Office는 한국 국내에서 장학생 본국 거주 지 역(또는 본국 범위 내 여행 목적지) 국제공항 까지의 최단거리 귀국 3등석 항공권을 장학생에게 제공한다, 단, TaLK Office와 시ㆍ도교육청이 허용하는 특별한 사유가 발생하여 위 기간을 충족 하지 못하는 경우에는 예외로 한다. 7. Airfare 7.1 Scholar's inbound flight to Korea shall be provided by the TaLK Office based on a one-way economy class airfare of the most direct international flight available from his/her country of residence to Incheon International Airport, Korea. In case of the termination of the Contract within one (1) month from the date of commencement, an immediate payment for the full amount of inbound airfare must be made to the TaLK Office by Scholar unless the TaLK Office approves of the nature of the circumstances. 7.2 Upon Scholar's successful completion of the Term of Scholarship, the TaLK Office shall provide a return flight to the Scholar's country of residence (or another destination if the value of the airfare is equal to or less than the original flight plan) based on an economy class airfare of the most direct international flight available. In case of the termination of the Contract before the original end date of the scholarship, Scholar shall be responsible for the return flight to their country of residence unless the TaLK Office and POE approves of the nature of the circumstances. 8. 주거 8.1 주거의 형태는 시ㆍ도교육청이 결정한다. 주거 형태는 홈스테이, 임대주택, 원룸, 또는 아파트를 포함하나 이에 한정되지 않으며 주거의 사용에 따른 제세공과금은 장학생의 부담으로 한다. 8.2 시ㆍ도교육청이 장학기간 동안 주거를 제공하지 못하는 경우 시ㆍ도교육청은 장학생에게 매월 한 화 400,000원의 주거비를 지원한다. 8.3 장학생의 주거가 선정될 때까지 시ㆍ도교육청은 임시주거를 제공할 수 있다. 8.4 주거를 제공할 것인지 주거비를 지원할 것인지는 시ㆍ도교육청이 결정하며, 일단 결정한 이후에 는 장학기간 동안 이를 변경할 수 없다. 8.5 시ㆍ도교육청이 주거를 제공하는 경우 시ㆍ도교육청은 가전제품 및 가구를 제공할 수 있으며, 장 학생은 시ㆍ도교육청이 제공하는 가전제품 및 가구 이외의 물품을 요구할 수 없다. 8. Housing 8.1 POE shall decide the type of accommodation for each Scholar. Housing selected by POE may include, but is not limited to, homestay, a leased house, a studio-type room, or an apartment. Any and all fees, charges, costs, taxes, expenses, etc. incurred in using the housing shall be borne by Scholar. 8.2 If POE is not able to provide housing for Scholar, POE shall provide Scholar with 400,000 Korean Won (KRW) per month, as a rent subsidy, in lieu of the housing. 8.3 POE may provide temporary housing until the appropriate housing for Scholar becomes available.

5 8.4 POE shall decide whether to provide Scholar with housing or a rent subsidy. Once decided, the decision shall not be changed during the term of Scholarship. 8.5 If POE provides housing to Scholar, POE may provide appliances and furniture. Scholar shall not request or demand any other appliances or furniture than those provided by POE. 9. 기타 9.1 시ㆍ도교육청은 장학생에게 정착금 300,000원을 1회에 한하여 지급한다. 9.2 시ㆍ도교육청은 장학생을 위해 여행자보험에 가입한다. 보험가입의 형태 및 보장범위 등은 시ㆍ 도교육청이 보험자와 계약한 바에 따른다. 치과치료 등 일부 질병의 경우는 보장범위에 해당되지 않는다. 9.3 장학생이 2개교 이상 장거리 순회봉사활동을 해야 하는 경우의 교통비 지급은 시 도교육청의 내 부지침에 따른다. 9.4 장학생이 영어봉사활동을 모두 마치고 장학기간을 완수한 경우에는 장학인증서를 수여한다. 9. Others 9.1 Scholar shall be entitled to one time settlement allowance of 300,000 Korean Won (KRW). 9.2 POE shall provide Scholar with overseas traveler's health insurance and POE shall choose the type of insurance plan. The insurance does not cover expenses for dental care or for any other pre-existing conditions, defined as illness, injury or manifestation of symptoms for which medication was prescribed. 9.3 In case Scholar teaches in two or more schools, Scholar shall adhere to the policies and regulations set forth by POE for transportation expense compensation. 9.4 A certificate of Korean Government Scholarship will be awarded at the end of the contract term to the Scholar who has successfully participated and completed all required parts of the TaLK program. 10. 봉사활동시간의 면제 10.1 시ㆍ도교육청은 장학생에게 위 3 항에 규정한 장학기간 동안 7일간 봉사활동시간(일)을 면제하 되(1년 계약자의 경우 14일간 봉사활동시간(일) 면제), 원활한 업무진행을 위해 시ㆍ도교육청과 학교장이 장학생과 협의하여 봉사활동 면제의 시기를 조정할 수 있다 봉사활동 면제시간(일)은 수업의 원활한 진행을 위하여 7일을 학기별로 사용하여야 하며 중도포 기자 또는 조기귀국자의 경우, 학교장이 인정하는 사유 외에는 봉사활동 면제시간을 부여하지 않는다 학기 초에 봉사활동 면제시간에 대한 계획을 학교장과 사전 협의하여 확정하고, 봉사활동 면제 시간을 받기 위해서는 15일전에 학교장과 협의하여 승인을 받아 수업에 지장을 주지 않아야 할 의무가 있다 봉사활동 면제기간 동안의 장학금 지급 등은 시ㆍ도교육청 내부 지침에 따른다. 10. Vacation Leave 10.1 Scholar shall be entitled to a vacation period of a total of seven (7) business days per semester (fourteen (14) business days in case of one year contract) during the Term of the Scholarship set forth in Clause 3 hereof. If the requested vacation period interferes with any work operations, POE and Scholar may arrange for alternate vacation dates Scholar shall take seven (7) business days of vacation leave per semester. Without the consent or approval of the Head Person of the Work Place, the vacation leave will not be granted to Scholar who leaves before the contract is completed The anticipated timing and duration of the leave must be discussed and approved by the Head Person of the Work Place at the beginning of the semester and Scholar shall apply for and obtain an approval from the Head Person of the Work Place at least fifteen (15) days in advance for any vacation leave For matters regarding the scholarship disbursement on the month when the vacation leave is taken, Scholar shall adhere to the policies and regulations set forth by POE.

6 11. 병가 11.1 장학생은 장학기간 중 봉사활동 할 수 없을 정도의 질환이 있을 때 소속기관장의 사전 승인을 받아 봉사활동시간을 면제 받을 수 있다 병가 기간이 연속하여 3일 이상일 경우에는 의사의 진단서를 소속 기관장에게 제출하여야 한다 장학생은 개인적인 질환으로 봉사활동을 면제받았을 경우 이로 인한 결강 발생에 대하여 별도의 수업을 진행하여 장학제도의 취지를 살려야 할 의무가 있다 병가에 따라 봉사활동을 면제받은 기간 동안의 장학금 지급 등은 시ㆍ도교육청 내부 지침에 따른다. 11. Sick Leave 11.1 Scholar shall be entitled to a sick leave if an illness or injury prevents him/her from performing the duties under the Contract, provided that he/she obtains the Head Person of the Work Place's prior consent When Scholar takes a sick leave for three (3) consecutive calendar days or more, Scholar shall submit a doctor's medical report to the Head Person of the Work Place Scholar is required to make up classes for work missed during sick leave For matters regarding the scholarship disbursement on the month when the sick leave is taken, Scholar shall adhere to the policies and regulations set forth by the POE. 12. 특별휴가 장학생은 장학생의 (조)부모, 형제/자매 사망 시 7일(공휴일포함) 간의 특별 봉사활동 면제시간(일)을 받을 수 있다. 12. Special Leave Scholar is entitled to receive up to a maximum of seven (7) calendar days of leave of absence in the event of a death of their grandparent(s), parent(s), or sibling(s). 13. 장학생의 준수사항 13.1 장학생은 TaLK 장학생으로서의 품위를 손상시키는 행동을 하여서는 안 된다 장학생은 봉사활동 이외의 다른 기관에서 취업 행위(시간제 근무 포함)를 하여서는 안 된다 장학생은 농ㆍ어촌의 초등학교 방과후학교 영어교사로서 학교 및 학생교육을 해칠 수 있는 활동 을 해서는 안 된다. 13. Codes of Conduct 13.1 Scholar shall not behave in any manner which may damage or tarnish the reputation of the TaLK program Scholar shall not engage in any other job (including a part-time job) during the Term of Scholarship set forth under Clause 3 hereof Scholar shall not be involved in any activities which may cause harm to the students or be of detriment to the reputation of the school. 14. 영어봉사활동 기간의 연장 14.1 학교장, 시ㆍ도교육감, TaLK Office의 허가 하에, 장학기간은 6개월 또는 1년 단위로 연장할 수 있다 기간이 연장된 장학생은 가장 최근에 개정된 계약서에 서명해야 하며, 그에 따른 규정을 준수하 여야 한다 장학기간을 연장할 경우 현 장학기간 완수에 따른 귀국항공권을 제공받지 않으며, 연장된 장학 기간을 완수할 경우 귀국항공권을 제공받는다.

7 14.4 TaLK 장학생의 최장 장학금 수혜기간은 2년이다 년의 장학기간을 완료한 후 기간연장을 득한 장학생은 7일간 봉사활동시간(일)을 추가로 면제 하되, 봉사활동 면제시기를 사전에 학교장과 협의하여 승인을 받아 수업에 지장을 주지 않도록 해야 하며, 본국까지의 왕복항공권을 1회 제공받되, 본국을 방문하지 않는 경우에는 50만원의 보상금을 지급받는다. 14. Extension of Scholarship 14.1 The scholarship term may be extended for another six (6) months or one (1) year upon the approval of school, POE and the TaLK Office Scholar on extended scholarship term must sign and adhere to the terms and conditions of the contract that has been most recently amended By extending the term of scholarship, Scholar shall defer entitlement of the return flight until the completion of the extended term of scholarship The scholarship term should not exceed a total of two (2) years With an extension after a one (1) year scholarship term, Scholar is entitled to an additional seven (7)-day leave and the anticipated time of the leave must be approved by the Head Person of the Work Place and not interfere with teaching schedule. Scholar shall be given either a round-trip ticket to their home country or 500,000 Korean Won (KRW) in compensation. 15. 자격포기 15.1 장학생은 위 3 에 규정된 장학기간 동안 임무를 수행한다 그러나 만약 장학생이 불가피하게 장학기간 중도에 자격을 포기하고자 할 경우에는 최소한 30 일 전에 중단할 일자와 사유를 서면으로 시ㆍ도교육청에 통보하여야 한다 장학생이 자격을 중도 포기할 경우에는 귀국항공료는 장학생이 부담하며, 장학생이 E-2비자를 소지했을 경우, 당해 비자는 취소된다. 15. Resignation 15.1 Scholar shall perform the duties during the Term of Scholarship set forth under Clause '3' hereof However, if Scholar should desire to resign from the Scholarship Program and thereby terminate the Contract, he/she must give POE a minimum of thirty (30) day prior written notice of resignation stating the date and the reason for the resignation In the case of Scholar's resignation, the airfare for the return flight shall be borne by Scholar, and his/her visa shall be cancelled if it is an E-2 visa. 16. 장학생 자격박탈 16.1 시ㆍ도교육청은 다음과 같은 경우에 본 장학생 자격을 박탈할 수 있다. (a) 사전연수과정에 불참하거나 사전연수를 이수하지 못한 경우 (b) 건강검진 결과 마약복용, AIDS 또는 전염의 위험이 있는 질병 등의 사항이 드러난 경우 (c) 장학생이 제출한 지원서의 내용이 사실이 아니거나 거짓이 있는 경우(허위학력 기재 등) (d) 장학생이 대한민국법을 위반하여 형사고발되어 1심에서 유죄판결을 받은 경우 단, 중상해 및 성범죄 등 중대한 법률 위반을 한 경우는 재판의 결과와 상관없이 고발 즉시 장 학생 자격이 박탈될 수 있음. (e) 장학생이 영어봉사활동에 대한 수업지도등 장학금 지급조건을 이행하지 아니하거나, 성실하게 임 무를 수행하지 않는 경우 (f) 장학생이 특별한 이유 없이 1주 이상 연속하여 영어봉사활동을 하지 않은 경우 (g) 장학생이 신체적 또는 정신적 질환이 있어 계속 봉사활동하기 어렵다고 판단되는 경우 (장학생은 시ㆍ도 교육청이 건강진단을 요구하면 즉시 이에 응하여야 한다) (h) '11'에서 정한 장학생의 병가기간이 장학기간 동안 총 15일(1년 계약자의 경우 30일)을 초과하 는 경우 (i) 본 계약서 13조를 위반한 경우

8 (j) 기타 장학생이 시 도교육청 내부지침을 위반한 경우 (k) 장학생은 사전연수기간 동안 이 계약서에 첨부된 원어민장학생사전연수규정 에 따라 벌점 5점 이상을 받은 경우 16.2 본조 제1항 각호의 사유로 인하여 본 장학계약이 해지되는 경우 귀국항공료는 장학생이 부담한 다. 그리고 장학생의 비자는 취소된다 '16.1'의 각호의 사유로 인하여 본 장학계약이 해지되는 경우 장학생은 7.1 에 따라 항공료를 즉시 반납하여야 한다 에 따라 장학생의 귀책사유가 발견된 경우에는 즉시 장학생관리위원회을 개최하여 자격박 탈 여부 및 시기를 결정하여 장학생에게 서면으로 통지한다. TaLK 사전연수기간 동안에 발생한 사안에 대해서는 TaLK Office가 장학생관리위원회를 주관하고, 그 이후 발생한 사안에 대해서는 시 도교육청이 장학생관리위원회를 주관한다. 16. Scholarship Disqualification 16.1 POE may disqualify Scholar from the TaLK program and terminate the Contract upon occurrence of any one of the following events: (a) If Scholar refuses to attend or fails to complete all required orientation activities. (b) If the medical test results reveal that Scholar has any serious disease(s) that is infectious or may keep him/her from performing duties & responsibilities (e.g. drug addiction, AIDS, etc.) (c) If any of the information provided in Scholar's application is neither true nor accurate (e.g. false or misleading information on education background and such). (d) If Scholar violates the laws of the Republic of Korea, is charged with offense and/or found guilty on the first trial. For any serious violation such as sexual offense or physical violence, scholarship is subject to immediate termination regardless of the results of the trial. (e) If Scholar fails to perform or unsatisfactorily performs any of the duties stipulated in the Contract. (f) If Scholar discontinues performing his/her duties for more than seven (7) workdays without any excuses. (g) If it is determined that Scholar is prevented from or incapable of performing his/her duties due to a medical reason, such as a physical or psychological ailment. (If requested by POE, Scholar must be immediately available for a medical examination.) (h) If the sick leave used by Scholar pursuant to Clause '11' exceeds fifteen(15) days or thirty (30) days in case of one year contract. (i) If Scholar violates Clause '13' of this Contract. (j) If Scholar violates the policies and regulations set forth by the POE. (k) If Scholar accumulates five (5) demerit points due to the misconduct during the orientation as stated in the attached TaLK Orientation Regulations In the event that the Contract is terminated pursuant to the foregoing Clause 16.1, Scholar shall be responsible for the return flight to his/her country of residence. Scholar's visa will subsequently be cancelled In the event of termination of the Contract pursuant to any of the provisions set forth in the foregoing Clause 16.1, Scholar shall immediately return airfare to TaLK pursuant to Clause For any violation pursuant to Clause '16.1', the TaLK Conduct Committee shall determine if disqualification is necessary. Once a decision is made, written notification will be given to Scholar in a timely fashion. For any violation that occurs during the orientation period, the TaLK Office shall constitute the TaLK Conduct Committee and for any violation that occurs afterwards, POE where Scholar in question belongs to shall constitute the TaLK Conduct Committee.

9 17. 연수 이수 17.1 장학생은 봉사활동 개시일 직전 TaLK Office와 시ㆍ도교육청이 주관하는 일정기간의 사전연수 를 이수하여야 한다 사전연수 기간은 3 의 장학기간에 포함되지만, 연수 및 체제경비 일체를 제공받게 되므로, 장학 금이 지급되지 아니한다 장학생이 사전연수 과정을 성공적으로 이수하지 못하는 경우에 장학생 자격이 박탈될 수 있다 장학생은 시ㆍ도교육청의 요청이 있을 시 심화 연수에 참여해야 한다 장학생의 전문성을 향상시키기 위한 시 도(지역)교육청 주관 행사 및 연수에 참석하여야 한다 기타 본 조항에 언급되지 아니한 사항은 첨부된 원어민장학생사전연수규정 에 따른다. 17. Participation in Training 17.1 Scholar shall complete the orientation (about 4 weeks) conducted by the TaLK Office and the Provincial Office of Education prior to their first term of teaching The orientation period shall be included in the Term of Scholarship as under Clause '3'. However, Scholar will not be entitled to any compensation during the orientation as all expenses will be covered by the government, including food and housing If Scholar does not successfully complete the orientation, his/her scholarship may be subject to cancellation Scholar shall attend TaLK mid-training upon the request of POE Scholar must attend workshops, training, and other events for professional teacher development provided by POE For matters not explicitly stated in Clause 17, Scholars shall adhere to the attached TaLK Orientation Regulations. 18. 손해배상 본건 계약의 이행 과정에서 장학생의 과실 및 위법 행위 또는 이와 관련하여 발생된 손해는 장학생이 시ㆍ도교육청에게 배상하여야 한다. 18. Indemnity Scholar shall indemnify and keep POE harmless from any liabilities or damages arising from or in relation to the Scholar's negligent, intentional or illegal activities during the Term of Scholarship under the Contract. 19. 정보제공 동의 19.1 장학생은 자신의 원어민 영어봉사 장학생 지원서 및 장학생관리카드에 기재된 각종 기록이 시ㆍ 도교육청 또는 정부의 통계 관리를 위한 목적으로 활용될 수 있음에 동의한다 장학생은 자신의 사진, 수업동영상 등의 자료가 TaLK 프로그램 홍보 및 자료 제작을 위한 목적 으로 활용될 수 있음에 동의한다 장학생은 학교장이나 담당장학사가 수업공개를 요구할 경우 수업을 공개하여야 한다 장학생은 장학기간 중 소속기관의 요청에 따라 활동체험수기 및 우수 학습지도안을 작성, 제출 해야 한다. 19. Consent to Information Provision 19.1 Scholar agrees that the information on his/her application form and TaLK Scholar Evaluation Card can be used for governmental statistics collected by POE and the Korean government Scholar agrees that data collected such as photos and video clips of himself/herself included can be used for promoting and producing materials for the TaLK program Scholar must open his/her classroom for observation upon the request of the school or

10 POE Scholar must submit an essay reporting his/her experience as a TaLK scholar and the best lesson plan that was used in class upon the request of POE and the Korean government. 20. 준거법, 언어 및 관할 20.1 본 정부초청영어봉사장학생의 권리 의무에 관한 사항은 대한민국법에 의하여 해석되고 결정되어 진다 본건 계약의 언어는 한글이며, 다른 언어로의 번역은 편의를 위한 것이다 당사자들은 본건 계약과 관련하여 발생된 분쟁을 해결하기 위하여 신의성실의 원칙에 따라 노력 하여야 한다. 본건 계약과 관련하여 발생된 분쟁을 상호 원만하게 해결할 수 없을 경우에는 대 한상사 중재원의 규칙에 따라 최종적으로 중재에 의해 해결된다 시ㆍ도교육청 및 학교가 주최하지 않은 사적인 여행이나 개인적인 여가생활 중에 발생한 사고에 대한 책임은 장학생 본인에게 있다 TaLK장학생은 정부 초청에 의하여 영어봉사활동을 하면서 한국문화를 체험할 수 있는 신분으로 노동관련법이 적용되지 않으며, 본 동의서에 대하여 다툼이 발생한 경우 속지주의 원칙에 따라 장학생은 권리를 보호받을 수 있다 기타 본 장학계약서에 규정되지 아니한 사항은 시ㆍ도교육청의 내부지침에 의한다. 20. Governing Law, Language and Venue 20.1 The terms of the Contract and the rights and obligations of the parties hereto shall be construed, interpreted and determined in accordance with the laws of the Republic of Korea The Governing language of the Contract shall be Korean. The English translation of the Contract is made for the purpose of convenience If a dispute or disagreement should arise in connection with or out of the Contract, the parties hereto shall first try to resolve it in accordance with a principle of good faith. However, if the parties fail to mutually resolve such disputes or disagreements or come to amicable settlements, their disputes or disagreements shall be resolved by arbitration in Seoul, Korea in accordance with the Commercial Arbitration Rules of the Korean Commercial Arbitration Board For any accidents that occur in private life inclusive of, for example, accidents in group gatherings without supervision of POE or school, Scholar shall bear full responsibility and liability resulting therefrom The Korean Labor Laws do not apply to Scholar, and if a dispute or disagreement should arise in connection with or out of the Contract, Scholar's rights are protected by the principle of territorial jurisdiction For matters not explicitly stated in the Contract, Scholars shall adhere to the policies and regulations set forth by POE. 21. 서명 시ㆍ도교육청과 장학생은 본 계약의 내용을 숙지하였으며, 년 월 일에 본건 계약서 를 3부 서명하여 각 1부씩 보관하고, 나머지 1부는 장학생의 비자 신청용으로 제출한다. 21. 12 - 가족/친지 사이(결혼/약혼은 해당사항 없으며 동성가족인 경우에만 해당)인 경우 - 질병 또는 사고로 인해 지속적인 치료가 필요한 경우 제 5 조 (외부인 출입제한) 연수생들이 연수에 전념하기 위하여 비연수생 및 외부인의 연수지 출입을 제한한다. 1. 방문신청자는 연수생과의 관계 및 방문 목적을 밝혀야 하며, 방문시간은 당일 의무참석 프로그램 종료 후부터 가능하다. 2. 연수생은 TaLK팀의 승인없이 방문자에게 숙박을 제공할 수 없다. 제 6 조 (규칙 및 금지) 연수지에서는 공중도덕을 지켜야 하며, 특히 다음 사항을 주의하여야 한다. 1. 사실을 비롯한 연수 장소의 청결을 유지하고 정리정돈에 힘써야 한다. 2. 질서를 지키며, 언어적 물리적 폭력은 사용하지 않는다. 3. 사실에 외부인의 출입 및 숙박을 금한다. 4. 흡연 구역 이외의 장소에서는 금연한다. 5. 카드놀이, 화투, 음주 및 고성방가를 금한다. 6. 방을 비우게 될 경우, 귀중품 보관 및 사실 시설에 유의하여 도난 사고를 미연에 방지하도록 한다. 7. 사실을 벗어난 연수지내 구역(복도, 공용이용실, 옥외공간)에서 내의, 잠옷차림 등 예의에 벗어난 복장을 금한다. 제 7 조 (통행금지) 모든 연수생은 안전과 충실한 연수를 위하여 다음 각 호의 외출 및 귀원시간을 준수하여야 한다. 1. 평일의 경우, 외출시간은 저녁식사 이후부터 23:00까지이며 외박은 허용하지 않는다. 2. 주말의 경우, 금요일 17:30(6교시) 이후 외출 및 외박이 가능하다. 단 주말체험프로그램이 있을 시 에는 해당 프로그램 종료 후 가능하며, 일요일은 다음 주의 충실한 연수 준비를 위하여 21:00까지 귀원하여야 한다. 제 8 조 (연수우수생 포상) 다음 각 호에 해당하는 연수생은 연수 폐회 시 연수우수생으로 포상한다. 1. 연수기간 중 지속적으로 반 대표로 봉사한 자 2. 영어캠프 활동시 수업 시연에서 최고의 평점을 받은 자 3. 연수생 투표에 의해 우정상 수상자로 선정된 자 포상 대상자는 반별 1인임. 제 9 조 (자격박탈)

13 다음 각 호에 해당하는 연수생에 대해서는 장학생 자격을 박탈하며, 이는 강제귀국을 의미한다. 해당 사항 발생 시 귀국항공권은 장학생이 부담한다. 1. 장학생이 연수에 불참 의사를 밝힌 경우 2. 건강검진 결과, 마약 복용, AIDS 또는 심각한 질병 등의 사항이 드러난 경우 3. TaLK Office로 제출한 각종 서류가 거짓으로 밝혀진 경우 4. 다음과 같은 사항으로 벌점 5점 이상을 받은 경우 벌 점 사 유 비 고 구두경고 1점 5점 - 강의 무단지각 (1회) - 연수지 내에서 고성방가, 음주, 도박 등의 행위로 타 연수생들의 연수생활을 방해하고 정부초청해외영어봉사장학생의 품위를 떨어뜨린 경우 - 사전허가없이 외부인 출입 및 숙식을 제공한 경우 - 고의적으로 시설물을 훼손한 경우 - 사실을 무단으로 변경한 경우 - 강의 무단지각 (2회부터 벌점 1점씩 누적) - 무단 결석 - 정해진 귀가시간을 준수하지 않은 경우 - 허가 없이 외박을 한 경우 - 기타의 행위로 타 연수생에게 피해를 주거나 공동생활에 적합 하지 않다고 여겨지는 경우 - 절취 또는 폭력을 행사한 경우 - TaLK 프로그램에 심각한 명예훼손을 초래한 경우 * 민ㆍ형사상의 소송에 연루되거나 연수지 밖에서 분쟁에 휘말린 경우 등 5. 상기 호에 해당되지 않은 연수생 관련 중대사항 발생시 연수생관리위원회를 개최하여 해당자의 벌 점 부여, 손해 배상, 자격 박탈 등을 결정한다. 제 10 조 (손해배상) 연수 중 공공기물의 파손 및 분실이 발생하였을 경우, 행위자가 변상하여야 한다. 제 11 조 (연수이수증 부여) 본 연수과정을 성공적으로 수료한 연수생은 본원 명의로 발행한 연수이수증을 수여받는다.

14 <Appendix> TaLK Orientation Regulations Article 1 (Purpose) These regulations are made for the purpose of setting forth the duties and conditions of TaLK Scholars (hereinafter TS) participating in the TaLK Orientation. Article 2 (Title) As a general rule, the official title of these regulations is the TaLK Orientation Regulations (hereinafter 'Regulations'). Article 3 (Application) The Regulations applies to each and every scholar who participates in the TaLK Orientation. Article 4 (Room Arrangements) The TaLK Office assigns rooms for TS, and the arrangements cannot be changed without the permission of the TaLK office. The TS may submit a letter of request for a room change. If the request is considered reasonable by the TaLK Office, permission may be granted to change rooms. Acceptable Rationales : - Family or relatives (same sex only) - Special medical care due to an accident or injury Article 5 (Visitation) Guests are not permitted to visit without prior authorizations from the TaLK office. 1. Visitors are to identify the specific reason(s) for the visitation and the relationship with the TaLK scholar(s) and cannot request a visit during lecture(s). 2. TS cannot provide, offer, or claim to provide visitors with accommodations without prior authorization from the TaLK office. Article 6 (Rules & Prohibitions) All TS are to observe public etiquettes at all times, including the following rules: 1. All TS shall be required to maintain a level of personal hygiene and be responsible for the cleanliness of their own part of the assigned room. 2. Offensive behavior of any kind (verbal or written, symbols or gestures directed at a particular person) is not acceptable. 3. No visitors are allowed in the room. 4. No smoking is allowed inside the building. 5. The consumption of alcohol and drugs, any forms of wagering (for goods, services, or money) and loud and disruptive behavior of any kind are prohibited. 6. TS shall lock their doors at all times when leaving their assigned rooms.

15 7. Inappropriate dress such as sleep wear including pajamas or bathrobes are prohibited outside individual rooms. Article 7 (Curfew) TS must observe the curfew policy set forth by the TaLK office. The purpose of the curfew is to ensure the safety of TS and to aid scholars in carrying out their responsibilities and be able to participate at their best the next day. 1. During the weekdays: TS may go out after dinner but must return to the orientation venue by 23:00. An overnight stay is not allowed. 2. During the weekends: TS may leave the orientation venue after 17:30 (sixth period) on Friday. If there is a weekend program, scholars can go out after the program is finished and must come back on Sunday by 21:00. Article 8 (Excellence Award) Awards for excellence will be presented to those who: 1. assist throughout the Orientation as a class leader. 2. receive the highest grades/ratings in micro-teaching at English camp. 3. are selected as a recipient of the Congeniality Award. one member per each class will be awarded in recognition of their efforts. Article 9 (Expulsion) Any TS who fall under the following criteria will lose their scholarship and must leave the country immediately. The airfare for the return flight shall be borne by the individual scholar if: 1. TS express their will to discontinue participating in the orientation or the TaLK program. 2. the medical test results show positive for any serious disease(s) including drug addiction and AIDS etc. 3. the information submitted to the TaLK office turns out to be false. 4. TS accumulate 5 demerit points based on the following misconducts: Points Types of Misconduct Note Verbal - show up late for a lecture (first time) Warning Misconduct, such as excessive noise, intoxication and gambling, that interferes with the learning environment or defames the reputation as TaLK scholars - Unauthorized guest visit of accommodation provision for visitors - Intentional damage to property - Habitual lateness for lecture (second time) - Absence without prior approval - Violation of curfew - Staying out overnight without prior approval - Any form of inappropriate or disruptive behavior that affects fellow scholars or the community negatively - Violence or theft - Serious defamation of the TaLK program * being involved in illegal matters A written warning will be given to those who receive more than 1 demerit point.

16 5. For any other types of violation or disturbance, TS Conduct Committee will determine the appropriate penalty based on the type and degree of misconduct. Article 10 (Damages) Damage, vandalism or destruction to property is prohibited and each scholar will be held responsible for any damage he/she causes. Article 11 (Orientation Certification) All TS are recommended for certification upon successful completion of the TaLK Orientation.
