6 . Current Legal System and Its Problems In recent years, Korean motor companies have obtained excellent results raking 5th in the global motor market and have developed cutting-edge technologies to some degree, while the regulation of secondhandcar transaction, which has a close bearing on peoples daily life, remains at less advanced level for along time. In particular, there are a great number of problems in secondhand car transaction, such as placing false secondhand car on the online market, the proliferation of unreliable information on the safety and performance of secondhand car and the contracts concluded by who is not the real person who is going to drive the car. Those problems in the transaction of secondhand car are very unique phenomenon happening in Korea because of the rapid advancement of motor industry and the boosting of online secondhand car market.

7 . Lessons from Other Countries In the light of these problems, this study is intended to draw some implications for the improvement of the legislation on the secondhand car business in Korea by comparing with those of other countries, such as the United States, Japan, France, Germany and China. Legal Improvements As a result of this comparative legal analysis, it is strongly suggested to enact so-called, Act on Secondhand Car Transaction to improve the regulation of the administrative organ conducting a safety and performance check to train skilled manpower for conducting a safety and performance check to enact ordinance to prevent from placing false secondhand car on the market.

Zu der Beschaffenheit nach Satz 2 Nr. 2 gehören auch Eigenschaften, die der Käufer nach den öffentlichen Äußerungen des Verkäufers, des Herstellers (Hersteller ProdHaftG 4 Abs. 1 und 2 des Produkthaftungsgesetzes) oder seines Gehilfen insbesondere in der Werbung oder bei der Kennzeichnung über bestimmte Eigenschaften der Sache erwarten kann, es sei denn, dass der Verkäufer die Äußerung nicht kannte und auch nicht kennen musste, dass sie im Zeitpunkt des Vertragsschlusses in gleichwertiger Weise berichtigt war oder dass sie die Kaufentscheidung nicht beeinflussen konnte. (2) Ein Sachmangel ist auch dann gegeben, wenn die vereinbarte Montage durch den Verkäufer oder dessen Erfüllungsgehilfen unsachgemäß durchgeführt worden ist. Ein Sachmangel liegt bei einer zur Montage bestimmten Sache ferner vor, wenn die Montageanleitung mangelhaft ist, es sei denn, die Sache ist fehlerfrei montiert worden.
